    In the offer and acceptance video you said there are four main elements to formation of contracts, offer and acceptance, consideration, intention to legally bind, and capacity. I found the first two videos very helpful and for the first time I feel like I actually understand contract, and so I would love it if you could do videos on the remaining two topics.

    Simon, love the videos! When you talk about Stilk v Myrick 1809 etc.. I don’t understand why this is not considered a counter offer. Ie. When the ships captain offered more money to the sailors in the voyage, then this is a counter offer, which according to your earlier video on offer & acceptance this would mean all prior agreements are null and void!!! Please help me to understand this...thank you!

      Hi Dave. A counter offer is basically a change to an offer suggested by the offeree of the initial offer. On these facts, the captain was the OFFEROR. He was making an offer of extra payment to the remaining crew - who were already bound by a contract. Those crew members had not made an offer to the captain. They merely accepted his offer of extra payment.

    Precedent upheld by pinnel’s case and foakes v beer still establishes the idea that partial payment of debts is not binding, ie it cannot constitute good consideration. Roffey brothers principles can only apply to part payment cases if there is something more than just financial benefits to the offeror to be seen as good consideration. Ie if the landlord offers tenancy to be paid by tenant for a smaller amount, as long as he stays living in the flat, since the tenant remaining and maintains the welfare of the property is another service that benefits the offeror, this is good consideration and binding on the landlord.

      Hi Kiwi. I would be wary of seeing Roffey as a precedent about part payment of debts. It is about an existing contractual duty as consideration for a further contract.

      LearnLoads I’m merely stating consideration can be deemed good concerning part payments as long as there is other benefits to the offeror other than monetary sources.

    Must consideration be the same amount as the offer ? For instance, I sell a bike to a friend for £100 but that friend can only pay me at the moment half of the price. Is there a contract that's enforceable in that case ? Thanks :)

    hi, may I know what if the party A agrees to transfer party B money, and party B said she will deliver the cake for party A once she make the payment. Then party A transfer party B money for the cake, and in this consideration what's case study that we can write about?

      In cash and $500 in Cheque, I can’t do anything more than that “ and John agrees to the offer. And James gives hi the cash and cheque. Later John sues James for the remaining $1000 would he be able to get it

    Totally unrelated to the subject matter of the video but here are a couple of things that make me laugh.
    Woman says, "I had considered dating him until I found out he still lived with his parents."
    It makes me laugh because she hadn't considered that he might not want to date her.

    It makes me laugh because what man would want to date a controlling and domineering woman? If a man doesn't already smoke, I can't think of a better reason for him to start.
