    I'm no legal expert but I find it hard to believe that an actual lawyer would "draft" this "letter". The entire "document" reeks of unprofessionalism. A good lawyer is also not going to tell someone they're getting ready to sue exactly what they're going to do, thus making their job more difficult potentially. Yeah, maybe a cease-and-desist letter. That would make sense, this does not in any sense of the word.

    To clarify this is not actually “serving” someone. It’s just a letter from a law firm which you can ask a law firm to draft up a letter for you so you can send it. Which is likely what happened here. If your client wants a generic “we are going to file a lawsuit against you” letter the law firm will just get some drunk paralegal to draft something. This is petty common
    If you actually file a lawsuit and need to serve papers to someone, each court has rules and processes as to what is acceptable or not.

    • @satorudo
      @satorudo Před rokem +15

      @@Greenleaf_ Note that because a letter has an attorney's name on it doesn't mean they actually wrote it. These kinds of demand letters are 99% of the time written mostly by paralegals and then just sort glanced over by the actual lawyer to sign off on. So yes the lawyer signed off on it, but it just means they looked at it and said "yeah that looks good". This stuff is all boiler plate generic "we are going to sue you" letters which at this point could be written by ChatGPT there is so much of it. This kind of stuff law firms charge a few hundred bucks for to stamp out for clients.
      But if you get a response from an actual lawyer from the other side, well THEN you start responding with actual legal stuff, via legal procedure, and start billing your client by the hour and that's where the costs start going up fast.

    • @satorudo
      @satorudo Před rokem +4

      @@thehoodedteddy1335 Note my guess is that the client asked the lawyer to draft a demand letter and send it to them via PDF. Which they dutifully did after getting paid a few hundred bucks. After that they dont' really care what you do with the letter. Then this galaxy brained NFT twat thought "yep let me send this PDF to your NFT wallet!" and send it. The law firm didn't do that, this NFT bro did it. The law firm doesn't really care how you sent this demand letter. they probably just assumed it as going to go through email. But again, they don't really care because they gave the client want they wanted and got paid for it.

    Sending an NFT to a wallet is kind of a genius way of serving legal notices because if the defendant publicly listed that wallet as his and is active with it, there is no way they can claim in court that they didnt receive the notice. In that way, i can see his reason for doing it that way. Because as we all know, these crypto scammers like to leave country when the noose gets tightened so if you can prove to a court that they received the notice to a valid address, physical or digital, the process of extraditing from another country is much more likely to be successful.

      @91XtremeRT Yeah but individuals don't file criminal charges. That requires a prosecutor request charges from a Grand Jury. Also, there's no court in the entire United States that will allow an NFT to serve as a valid form of service of process. These guys are jerkoffs.

      @15Bravo Před rokem +3

      @@Treklosopher You say that with the confidence as if you know for certain there is case law supporting your opinion. Until it is tried, it is not possible to know if it can or can not be done. But given the relevant evidence surrounding the particular situation, it wouldnt be out of the ordinary for a judge or grant a search warrant. And within that search it corroborate the plaintiffs claims and there would be immediate criminal charges issued against the defendant once all the evidence is sifted through and sorted.

    • @satorudo
      @satorudo Před rokem +5

      Note that actually 'serving' someone has EXTREMELY specific rules for each court. And if you do not follow those rules, you are absolutely positively going to be in a shit load of trouble for not following procedure. Dumping it into an NFT wallet will never be accepted by any court, and the lawyer doing that would get censured for doing so. In this situation, it was the galaxy brained NFT dude who sent it to the NFT wallet and thought they were being 'clever'. But no lawyer is going to do that because they're gonna get reamed by any judge, even one high on a weekend weed bender. This was a demand letter which has no real rules of how to send them as long as the person on the other end 'sorta might maybe possibly' get it. You could at them on Twitter and that would be fine too. This isn't an actual service of a lawsuit so it doesn't matter how you send it really. My guess is the law firm didn't do it though. It was the NFT dude that did that on his own. He just paid the law firm to draft up a 'im going to sue you' letter and give it to them in PDF.

    • @satorudo
      @satorudo Před rokem

      unless you're in law or music, treble isn't a super common word. Most people would assume 'treble' is a misspelling of 'triple' since that's what it functionally means in the vernacular. Its a sort of law specific usage and most people would be unfamiliar with that term.

    It must be awesome to be a lawyer, and be able to represent yourself and serve people, and threaten lawsuits. To know the system and do it for free on your own time.
    But I guess most lawyers are too intelligent to get scammed in the first place, so it rarely happens.
