It's not an excuse, it is presumption of innocence. Every defendant in criminal trial is entitled to be considered innocent until proven otherwise.

If he is not guilty, he should face the courts, if he has nothing to hide. And you are wrong when you say that the charges were filed by individuals in the US. Even if the individual did not file a case, the FBI by law on its own capacity can file the case and that is what is happening now.
