It could be a case of the fact they truly didn't know what the NDA did or did not cover, especially if the contract was vague. Also if you can't afford to lose your job, you risk getting fired regardless of NDA agreements. The ones who came out are former employees not current. Stands to reason they didn't have the freedom to say anything while working there at least not financially.
NDA was broken by Twitch employees with no proof of crime. Otherwise there would have been a criminal investigation.

NDAs don't prohibit reporting of criminal behavior, nor do they protect a person from being charged as an accessory.

If it indeed was a minor then they are protected and evidence likely can’t be shown for legal reasons. Which further makes him look even more guilty
His best strategy, IMO, is to release the texts. If they are damning, then nothing changes, but if there is for some reason a context that renders them less heinous than we are already imagining, then it might do him some good. At this point it is best to come clean and fall on the mercy of the court.

However we also know that this was probed criminally and nothing was found- and his confession also says that it pushed against the line of being inappropriate- if it was TRULY inappropriate it'd be charged criminally- you can't speak in a sexual nature to a minor- it's a crime, I passed the California BAR exam, I've practiced law I know what I'm talking about.
What we need is more than a qualified admission of guilt- we need to see these logs- or we need to hear from an actively employed Twitch representative.

1. NDA's are null and void when it comes to criminal acts. Nothing stops you from being blacked balled by the industry for being a snitch either. True rule of life is the good guy never wins.
2. Sad reality is that law enforcement doesn't care/will do nothing about messaging minors. They don't have the man power and resources every time someone messages a minor.
3. When it comes to the settlement; imagine what would happen to Twitch if the public finds out that their kids aren't safe from the platform/content creators. Twitch viewership, stock, etc...would vanish over night. Lose billions over night, or pay several millions to keep things under wraps.

My understanding of NDAs are that they can't stop the person signing it from speaking out about a crime they're witnessing; they are also only valid from the moment they're signed and can't cover anything that's learned or seen before that point.

Omegon, from what I have discovered about NDAs due to having the same question in my mind, NO. An NDA is not binding if it is meant to cover any criminal act.
Most DNA's are in fact easy to breech without penalty. I understand the fea we might have once we've signed one, but there are many laws that these are meant to deny us to use freedoms here in the US.
An NDA might, for instance, force is to waive our Fifth Amendment Rights to not self incriminate, might attempt to force us to be unable to protect of defend ourselves from false prosecution, and so on.
The person posting about the sickening things they saw daily needs to consult an attorney about the validity of the document they signed, and if they can take their knowledge and hopefully, receipts to Law Enforcement. They may fear being dragged into any cases based on their silence, but I truly think not. If nothing else, they can seek immunity in exchange for their information.
No amount of NDAs would hold up in court. An NDA is only valid if it is to protect Privileged information that is non criminal.
An NDA can be used to protect conversations that happen within a business, as that privileged information could give their competitors an Edge.
An NDA cannot be used to silence someone from reporting/talking about a crime.
If you sit in front of a judge and say, "I cannot discuss this as it's under NDA", The judge will just go closed chambers, Instruct you to divulge the information, then Decide Whether or not the NDA is valid and reopen the chambers. If the information is incriminating and brings light on unlawful activities, The NDA will be squashed. That is the move which best serves justice.
If you open your mouth before going in front of a judge, The other party may threaten you with legal actions. However, this again needs to sit in front of a judge To get past the first stage. A judge will look at the case, See that the NDA violation is about disclosing illegal activities, and either squash, or put the case on hold. The main question the judge will have is this... Why are you suing them over violating an NDA rather than defamation?
This question is key because defamation is damages for untrue statements. An NDA Can only cover information that is disclosed to you. A false statement is information which you have made up, which by its nature, means it was not Information disclosed to you by the other party. If the statements are true, And is information that was disclosed to you, If that information is of criminal activity, the NDA cannot protect it.

I think twitch is not going to try and sue doc because from what others are supposedly saying at twitch (all anonymous) that there are way more big streamers who were doing this as well, and if they sue all of that would be discovered by doc attorneys.
Also, there is no NDA that makes you withhold a crime.

If you break an NDA to disclose criminal conduct, there needs to be absolute proof. Because of how the law works in the USA; you are innocent to begin with regardless of any accusation. No matter how horrible the accusation is. The burden of proof falls upon the ones making the accusations. Therefore, if no wrongdoings (criminal acts) have been found, then you remain innocent. Hence why its stated as "No wrongdoings FOUND," instead of "No wrongdoings DONE." The whole point is to find out if a person is guilty, not if they are innocent. In this case, since no wrongdoing was found; the former twitch employees violated the NDA.

I knew who Doc was and had seen some of his videos, but I don't follow him. Him propositioning a minor to meet up, but it not being illegal is also interesting. If Twitch knew about the legality, and didn't tell the authorities in that moment they could be in legal trouble, but only if what was going on was illegal. Not defending Doc here. A 14yo can go up to 19; or 20 for a 15yo (up to five years older than them).
There are rules around people 18+ "in positions of power or influence" (e.g. a teacher) not being allowed any s**ual contact with anyone under 18 though.
Well, there are a few things to consider:
- definition of inappropriate. While it's easy to assume a sexual situation, it could also mean foul language not suitable for minors.
- it's possible the minor did not present themselves as such, and misrepresented themselves as an adult. Which was later found to be false.
- he was setup
I'm not trying to defend someone who is truly guilty. But rather provide things to consider instead of condemning someone without all of the details. Unfortunately, getting the details to the whole situation probably won't happen.

The content looks good but only thing that I didn't like is you were using automated machine voice( I am not completely sure, forgive me if I am wrong). If you can use your own voice, then I think it makes the video and the narration even more better. For me personally for videos more than (let's say) 3 minutes, hearing human voice seems more pleasant and comfortable than automated machine voice. Good work.

My guess is that nothing "illegal" happened, just sketchy. Specifically, I assume that Twitch came down hard on him because he was planning to hang out with the minor at Twitchcon. There is nothing illegal there, however I have to assume that given previous messages between the two, much was assumed about what was going to happen there. The reason it ended up being settled, I assume has to do with Twitch not moderating their 18+ message system well enough. I'm assuming that the minor right out stated their age maybe before at least some of the spicy messaging happened or possibly as they planned to meet up and then DD kept scheduling despite the age reveal. So both sides did not want this out there because while not technically illegal, would be shady. As for why it is coming out now? My guess if the person who leaked it doesn't get dragged to court? There was some form of NDA and it just lapsed. In fact, seeing as people are apparently now able to confirm things (DD's company being able to get info enough to drop him) despite people digging for this for years, that seems the most likely reason. What happened wasn't illegal and so the NDA did keep them quiet, but now they're all talking and thus why it all suddenly blew up out of nowhere.
Also, if he was actually sexting a minor that would be illegal in California and in most states, I believe. Twitch would have to report that. They would absolutely have to report that, and maybe they did, and obviously nothing illegal was found or it would be public record. So, doc clearly wasn't sexting. I'm not trying to stick up for the guy I'm just saying it couldn't have happened or he would have been charged. He probably walked a very VERY fine line of largely being a creep and almost being a pdf. Because here in the US the government would HAVE LOVED to make an example out of someone like him if they could have.

It would depend on where the crime was committed. I * think * this was in California, where the Age of Consent is 18, so anyone below that would be a minor. But if he was in another State when doing the messaging, their law would apply.
