    She admitted getting paid $50 for every lawsuit filed. Ironically, the group starting all these lawsuits, does not have a disabled parking spot, and the building is not accessible.

      @@bobberguy1 That is not always the case, business spaces are handled differently than housing. There are remodling clauses to the scope of the business ect. and alot of upkeep is transfered to the tenant. Our shop is responsile for the upkeep of our parking lot, curbside, and windows and such. Also any signage required for statute copliance is also our responsibility.

      @@bradcrosier1332 In Britain, Canada, Australia, and New Zealand, you almost always have to pay legal fees if you lose, and its designed to explicitly stop this (and also so that a person who suffers gets all their compensation not just whatever's left over), provided its reasonable and not a "small claim". She'd also have to answer for Perverting the Course of Justice in Criminal Courts and (which also exists in the States) Malicious Prosecution.

      No she’s not, she answered an ad in the paper or online to be the disabled person on their payroll so these lawyers could scam businesses out of money. It’s cheaper for the mom and pop companies to settle out of court for $10 or 15K than to go to trial and that’s what they count on. That crook in the wheel chain wasn’t discriminated against in any shape, form, or fashion.

      I prefer the current system where egregious cases can warrant the plaintiff being ordered to pay the defendants court costs. Having loser always pays winners lawyer fees just stacks things to the rich corporations being the only ones who dare file a lawsuit.
      I do hope the state goes after the organization that was ordering the extortion attempts.

      I’m willing to bet that her useless lawyer failed to inform her that if she ever won a big settlement, she’d lose all of her government funding. No more Medicare, Medicaid, or SSDI. The money from the settlement would run out quickly and she’d be SOL.

      She did not have to perjure herself to file a nuisance claim. The point of hiring her was for her to go to businesses and LOOK for violations and then be willing to be a witness that she was there and the violation was present.

    the law should be written that if a individual/attorney/business that file 5 or more frivolous lawsuits in a year, they should geta felony conviction and 1 year per frivolous lawsuit. on top of the that pay all costs for the defendants. none of these debts can be written off in any kind of bankruptcy

      I like that but no legislative body would be brave enough to pass a law penalized a "Marginalized" person. Certain people with a more "progressive' ideology would instantly be against it, without ever looking at it's merits.

      the courts will call a lawsuit against their friends frivolous, so be careful about such a law. a law suit filed against the police department for failure to enforce the public safety laws, will be dismissed unless the race card is used. if it is based on wealth and not race, it will be dismissed as frivolous. if you try and sue a judge for their constitutional trespass, it will be dismissed as frivolous, get the picture???

    The way to deal with this is to remove the ability to sue business for shortcomings. Establish an agency where reports can be filed, independent investigations happen and fines issued if not brought up to code within a reasonable time. A lot more efficient and you will get to see results.

      In most cases the business owner has no idea there is a shortcoming. It's insane that there isn't a requirement that the business be notified and given a chance to correct the issue before a lawsuit can be filed! Even a municipality should not be able to issue a fine until they've been given a chance to fix the issue!

      @@jblyon2 That is the way it is in Florida. You are first given reasonable time to fix the problem. Lawyers there would first offer to "settle out of court" but if the business decided to go to court they immediately dropped the case because they knew that once in court their scam would be seen for what it was. Basically the whole thing was a massive shakedown scam.

      there was one doing this near me in the Sacramento area that caused quite a few businesses to go under. the "handicap" person would ask to use the bathroom and then would find any reason for a violation and sue. most businesses didn't even have a public bathroom but because they let him use it, it was argued in court that is was accessable to the public and thus a public bathroom and subject to all the ADA laws. I think the lawsuits stopped once someone got the guts to counter sue and won

    The ADA has done more harm than good for disabled people. Many employers who would have been willing to hire disabled people in the past, won't touch us with a stick now because of the potential liability. And, I can't blame them one bit.

      I was working with companies when ADA was being in acted. We helped companies make their work spaces ADA Compliant. This meant being able to have a workspace available to meet a disabled persons needs. The companies got great productive people. Unfortunately we don’t catch enough of the bad people who are abusing the law. Hopefully this person will not only lose her license to practice law but will be fined and in prisoned.

      You mean AID has done more harm than good because your statement is exactly why the ADA is necessary. AID is not an advocate for people with disabilities but they have inadvertently revealed a flaw in the law. Businesses should be given an opportunity to remedy any violations before legal action is taken. Also, a lawsuit should never be filed by someone who never had any real intent to be a patron at the business.

    Yea, she has regrets. She thought she was gonna get rich for being disabled. The vast majority of ADA lawsuits are unfounded, frivolous, or in some way without merit. This happens all over the country with so called "activists" going around with measuring tapes, levels, etc. hunting for some slightly too high sinks, slightly too steep ramps, slightly too narrow sidewalks, etc. and filing suit seeking settlement. Businesses settle the nuisance suits for a few thousand dollars and the shysters move on to the next victim.

    Hadn't thought of this before concerning this stuff. But I wonder if the proliferation of security cameras everywhere and the ease of recording at a moment's notice with smart phones haven't made some of the "fall down artists" a littler leery abut what they can do or not do when they think no one can see them.     It amazes me how a lawyer can be this unscrupulous and put their law license in jeopardy. Lawyers have boundless legal cases they can work on without fraud. If you aren't a big corporate lawyer or Wall st. lawyer you can be hit with the broad side of the law. Maybe they are confused about their lawyer status in the big scheme of things.

    I hate to say this but how do people get from their place to wherever they are trying to get in? otherwise they have made and provided their own means to get from their house (inside) to wherever they are trying to access which I believe new places should be built to accommodate but old place the people should bring their own means to gain access.     I was out of work because of the housing bubble burst and got two traffic tickets. One was for a headlight being out (that's why I was pulled over) and the other for expired insurance. Together both tickets came to just over $1,000 dollars. I didn't have that kind of money and even if I did it would've meant I'd have to go without eating for weeks. So, I hired one of those shyster lawyers you see that advertise in the news paper classifieds. I paid him $100 dollars and he went to court for me. He kept postponing my hearing for various reasons for over 3 years. Finally the cop that gave me the tickets didn't show up and the tickets were dismissed. And you know what, I don't even feel bad about it!

    I’m sorry as a disabled person with a disabled wife the woman whose name these cases were in should also have some culpability. Just because someone is in a wheelchair doesn’t automatically make them a good person or a victim. Anyone who is part of bringing 99 cases knows or should know there is something wrong. We strive to be treated as equals and that equality means being treated exactly the same as an able bodied person. Restaurants and meeting places that many disabled people probably used have been shut down. How does that help the disabled elderly, blind people who have learnt that environment or veterans with PTSD who use those establishments as meeting places? There is no hierarchy in disabilities.

    Years ago there was a man who went around to night clubs that advertised "Ladies Night" giving women free admission and discounted drinks. He sued every single one of them until there were no more ladies nights...Now I like ladies as much as any healthy heterosexual man does ,I completely sided with the guy. The reasons to eliminate ladies night are endless. I don't think any explanation as to the reasons is at all necessary.

    So if there constrution work and blocking the sidewalk for people that have wheelchair can they sue for not having it inaccessible?
    Or if the wheelchair person goes to a building but all elevators are out of order they can sue for inaccessible?
    This is what I call bullshit. There mistake was filing all those lawsuit if they waited finishing a 2 or 3 lawsuit at a time they would have never being caught.
    Just because your a lawyer and think your damm smart doesnt your going to get away with it.
    Even smart people do dumb/stupid decisions.

    One of these ADA fraud mills tried to pull this same shit on me. They mailed me a one page form letter which made the accusations and had a space for me to fill in my insurance company/policy#. They even included a self-addressed stamped envelope for me to return it in. It was clear that their sole intent was to shake down my insurance company with a nuisance lawsuit. I ignored it. Later they mailed me the same form and a bogus boilerplate lawsuit with my name plugged in which was "ready to be filed" if I didn't respond. I ignored it. Later the shyster lawyers called me threatening me. I laughed in their faces and dared them to file the lawsuit. I never heard from them again. Much like burglars who skip houses with dogs and security systems, they moved on to easier prey.
