INELIGIBLE PERSON IN POSSESSION OF FIREARM REDUCED SENTENCE MINNESOTA LAWYER EXPLAINS

  • Minnesota criminal defense lawyer Ryan Pacyga explains how he helped a client avoid the mandatory minimum 60 month / 5 year prison sentence for ineligible person in possession of firearm or ammunition under Minnesota statute 624.713.
    During an alleged road rage, gun pointing incident, the alleged victims called 911 and law enforcement began looking for my client and his friend. The two defendants ditched the vehicle and ran into the woods, along a river, for several miles. Law enforcement seized the abandoned vehicle, and a judge ruled that they could search the vehicle without a search warrant. Inside the vehicle law enforcement found LOTS of ammunition all over the cup holders, center console, driver's seat and floor. Dogs eventually helped law enforcement track the two defendants down. On arrest, law enforcement also found ammunition in my client's pocket. They never found any guns.
    The State of Minnesota charged my client with possession of ammo/firearm while having a previous conviction for a crime of violence (domestic assault); 2nd degree Assault (dangerous weapon); threats of violence and other charges.
    My client faced a mandatory minimum of 60 months in prison. The judge did not throw the evidence out. Faced with those facts and the the other defendant (with a different lawyer) pled guilty, my client felt trapped. The evidence was bad (possessing ammunition is the same punishment as possessing a gun), but he didn't want to be gone from his family for so long. We negotiated a downward durational departure. He will serve 24 months instead of 40 (good time is 1/3 off of your sentence in MN).
    I've had some of these cases thrown out and trial wins too. But every case is unique. Sometimes facts are real bad and evidence isn't thrown out. In those situations, sometimes a good outcome means a reduced sentence, which is what a downward durational departure is. There are other reasons why this particular outcome was good under the circumstances, but those are private details. What's important is that the client was very happy with that outcome under the circumstances. He will get back to his family much sooner, and hopefully will put this behind him and move forward in a productive manner.

    know any decent civil rights lawyers in mn? I recently was charged with possession of firearm and had the possession charge dropped due to being eligible. I'm hoping to recover the legal fees I took on for my lawyer to just make 1 phone call for 7k before prosecutor to dismiss
