    ▶ About me!
I'm a motovlogger from Phoenix, Arizona! I've been riding motorcycles since 2015. My first motorcycle I learned how to ride on was a Suzuki GS500F. After taking a motorcycle safety course and finally gaining some confidence on the streets, I decided to purchase my second motorcycle. A Honda CBR600RR. I still own that motorcycle to this day! After some time passed I decided to add another motorcycle to the family. So I purchased a Yamaha FZ-07. That's another bike I still have to this day! Again, more time passed and guess what I did. I purchased my final bike, as of now. A Honda Grom!
    ▶ What's a motovlog?
A motovlog is a type of video log recorded by a person while riding a motorcycle or any motorized vehicle. The word is a neologism and portmanteau derived from "motorcycle", "video" and "log". A rider who creates video blogs known as a motorcycle blogger, and the action of making motovlogs is called motovlogging.

@@grendal113 Its amazi9njg how many of you actually believe that. If its open to the public in a good number of states have 1 of 2 things that allow them to actually write you tickets.
1 - Several states have laws on the books deeming open to the public shopping centers, strip malls and thoser type of places to be in public interest and give the police authority to treat it as a roadway. I was not even aware of this until another video had me looking this stuff up and yep, its in the laws.
2 - If the state does not have it several cities in states have this setup as well
3 - If neither are present the local PDs actually contract with (ie are paid) to treat the parking lot of shoping centers etc as public roadways. This is actualy prety popular and happens in a LOT of cities around the US.
People get on this "its private property" psuedo law scholar tilt without ever looking it up to see if they are right. It varies but a lot of states, cities have the law and a lot of PDs contract with a lot of the shoping centers etc when the law isnt present.

@@scimbrelo done this in other threads but you should check into some laws son. Commonj sense law doesnt exist., Turns out a LOT of states have laws on the books turning shopping center type parking lots into public access points and meaning cops can enforce road rules on them. Other Sometimes the city does this when the state does not do it, and sometimes cops contract with these private businesses.
In a nutshell its actually a greater chance that this cop is perfectly fine to treat that particular parking lot like just another roadway.

It's not the cops JOB to enforce public property laws and rules on PRIVATE property. So the officer was completely out of bounds for even trying it.
I once got pulled over for apparently passing an almost invisible STOP sign at the super market. Don't know what was going through his mind, but I said "Officer, you are aware this is private property correct?" This isn't a public right of way"
Unless you have a specific request from the property owner or on premises manager this isn't hour domain. The Town didn't put these signs up, so they are not enforceable signs.
He replies "well we have gotten complaints from the establishment"
I said "O'Reilly? When was this?"
      Him "This morning"
"I said cool, mind me checking with (name hidden).
The bravado faded QUICKLY I knew he was bull-sitting and preying on shoppers leaving for tickets and court fees.
In most towns they don't care if they are wrong or right m, the court collectable a fee whether you are innocent or guilty. If you choose to defend your self there is a $59 dollar fee to fight it, and a $60 dollar fee to plead guilty, also a 39ndollar fee to just pay it before court. So they get a fee regardless.
So I called my boss told him what's happening and how this officer has been sitting at the corner of the lot farming customers leaving the store.
I have never seen a well of man, come outside in that much of a hurry. He had heard of complaints from customers about this but never saw it first hand. 5 mins later his patrol Seargent was on the scene. Officer got chewd out, his Sergent I could hear "YOU NEVER DO TRAFFIC ENFORMENT ON THE LOT, ALL YOU ARE DOING IS CAUSING PEOPLE NOT TO COME HERE".
What ever happened after that, don't know. The owner sent his lawyer to deal with the Town and I guess they got some sort of enforcement criteria established. Never saw another person get pegged for rolling through a empty parking lot at 2 AM.
IMO, the cop was salty, my truck was in for repairs, so the dealer leased me a fancy F150 the limited make me look like a drug dealer edition. This thing had it all. LoL. Probably $139,000 retail.

Just as that biker has EVERY right to not answer his questions. However, by refusing to answer questions or answering with vague responses, the biker complicates the situation that doesn't need to be complicated. How do you not understand that? Your right to remain silent should not come before common sense. Unfortunately in people who have this self entitled attitude to buck authority, commen sense is rarely found. The last straw for me is when one of the other tenants started smoking in his room and the smoke would come through the vents. I reported it twice. The landlord said if it happens again the other 3 would be evicted. I started looking for apartments the last time it happened and moved into my new apartment 4 days later. I was done. In this interaction, when he asks "do you own this? he says "we live here" so no they don't own it. now their land lord might, but regardless, no ownership means that the resturant could be filing a complaint.
he even says "i could block off the driveways" meaning that he's not on the slice of property he owns.
The cop was in his full rights to ask him to stay on his property, and the dude was super understanding.
My family owns a farm, and my little nefew drives down to a local printshop owned by a family friend on the gator, and the farmers between us and that shop have given him premission to use their driveway, one day a cop pulled him over, and when we explained that, he just asked my cousin not to go on public roads because 10 year olds aren't allowed to drive on public roads. Perfectly reasonable request and he sticks to where he is premitted to drive. just because that printshop is technically right beside our field, doesn't mean it's "our property". the field is cut out seperately on deeds than that lot is.
Odds are when he was younger, the resturant owner saw him riding there and thought "well if he's here he's not getting crushed by a truck on the streets" and ever since he just assumed it was ok, or the resturant owner spesifically asked him to ride there for his safety. that's information the cop can't know (since he either just saw the dude riding, or dispatch was informed a manager reported it) and so he's acting in everyones best interest.

@@TMar1961 you can get the information when he dodges the question of the cop asking them "oh your family owns this?" and he responds "i live here" which isn't a no and it isn't a yes. So for the sake of argument you can assume the refusal to deny ownership or accept ownership implies it's not owned by his family, as if his family owned the business the easiest way to get the cop to leave is to say yes since at that point he has full rights to be there.
The cop may ask him to ride somewhere else in the intrest of public safety (the public being the guy he's asking to ride somewhere else) due to the proximity of the main road, he could be worried someone will come flying into that parking lot and hit him. He may not threaten action against him if he refuses to ride somewhere else, as no law has been broken (since as you stated he's on private property) and I would personally state (though it could be contested) that he was in the wrong to ask for ID when he thought the guy was lying about living there. Though I will give him points for not pursuing the ID and getting physical when it was denied.
So while you are correct that he cannot take action against the guy (for instance if the dude just kept riding in the main parking lot ignoring the officers request) he can ask the guy to do something he deems as safer for him as a rider.
The situation is diifferent if the store is seperately owned and a manager is asking the cop to remove him (which doesn't seem to be the case as the cop drops it after their conversation) since at that point the private proverty owner is asking for a removal.

The police do not have authority to enforce traffic laws on private property, it doesn't matter legally if he or his family owns the property or if they rent the property from the property owner,, it's still the sole decision of the property owner if he can ride there, not the police.
All parking lots to private residences and private businesses are private property. Public property, where police have legal authority, is paid for by American citizens public tax dollars. Private property is paid for by the private owner, which is why the police do not have legal authority over private property, the property owner does. One of the main tenants of freedom in America is private property ownership, its what sets America apart and as being better than dictatorships, police states, totalitarian regimes and dictatorships, such as China, North Korea, and Russia, which do not have privateproperty ownership, or private business ownership, everything is owned by the government. If you want to call out bad cops, I applaud you, this is so far from tyranny there is an ocean between tyranny and this cop… Property owners get nuisance tort lawsuits and claims by idiots doing this type of stuff so often that they usually encourage the police to do exactly this. At no time did the biker say he owned the property, he said he stayed there. This is a very strong indication that he rents, and since the entire commercial properties parking lot is likely not on his lease, he is trespassing. Even if he isn’t trespassing, the actual owner can give permission from the police to monitor the property even if a tenant doesn’t agree

I can see the officers point of view - you don't need extraneous injury/accident/trespass reports and some small business owner left with an insurance claim from the possible parents.
But, while many of these small plazas have posted signs wanting young people riding mopeds/bikes/skateboards/inline skates or playing parking lot/road basketball/soccer/hockey to stay away, many of them also have apartments at the back or on the second story - and a sensible officer aware of is patrol area should be up on that.
They should also as a practical strategy make friends with the young folk found way from school areas (maybe even known gang areas) rather than antagonizing them, because those kids as a group know the area and get around much more than the patrol officer in his vehicle. Maybe not so much now with mobile phones/dash cameras/security cameras and better and better google map streetview, but teenagers were the best eyes and ears to talk to and still remain so in those out of the way places only stray drones and trail cameras may get a view. And being kind to youth is also being kind to the future crime rate.

    • @armacham230
      @armacham230 Před 5 měsíci

@HD_Spike Unless it changed, which it very well may have, not all states had this. I used to work security on completly private property in a massive gated complex and the entitled pricks who live there would drive around drunk occasionally leading to security vs resident chases. Was really goofy and all we could try to do is lock down the entrances to keep them contained at least in the neighborhood while the security patrol cars chase them around inside. But every once in a while these morons would screw up, apparently forgetting their immunity only existed on the private roads and although I never saw it happen, they would apparently turn into the neighborhood while a cop was trying to pull them over for a violation committed on the public roadway, and expect security to block the cop from following them in, which obviously was not going to happen. But at least for a while and maybe to this day, the police could only get them within the confines of the neighborhood if they followed them in from the outside after observing a violation on a public roadway. Essentially that neighborhoods roads were classified as completely private. So you could drive however you wished just as you could on your own property. If you happend to own 50 acres of land, you were free to drive as reckless and drunk as you wished as long as you didn't touch a public road at any point.
I did hear from a cop buddy quite a while ago that he believed they were starting to be able to enforce traffic laws in there, so I'm not sure if this was a private agreement, or a reclassification of the road network.
Was a really bizarre place, I lasted for about 4 months before deciding to go back to working a normal security job where they didn't expect us to essentially role play as cops since the neighborhood was salty that they were denied Village/Township status and therefore were not allowed to form their own police force.
