      I think the pricing was scummy (I mean come on, absolutely ridiculous) and DOING THIS ON KICKSTARTER was the worst part of it because had it gotten taken down after the kickstarter closed and money was paid, what then?

      Nintendo should create a retro team thats soul job is to market to the people that want retro nes era. Cater to that group, and this kind of stuff may slow or stop. Unfortunately Nintendo is really out of touch in what reteo gamers want. Look at the new NWC ( Nes remix) nothing close to a NWC original concept.
      This was a bad idea from the start. Much like princess rescue for atari and was hit with a cease and desist due to a MARIO like shape in the game. The creaters of this has done repro's before ,but at retro expos with out the mass public visability of kick starter. The creators have no real claim to any to Nintendo IP's. Bad idea all around.

    Pat, don't worry about coming across as a scold. Its not scolding to tell people not to walk into traffic. This game seems like a cool idea and I would probably want to pick it up if I came across it, but the people making it should have realized that making a product with IP they dont own and then advertising it everywhere is crazy. Back in the 90s you wouldn't see ads for bootleg VHS in the paper, this is that. Come on guys.

    Any ROM hacks that use active properties (in this case triple of Mario, Rad Racer and Tetris) are risking take down orders in the least.
    What we did for the first Game On Expo cartridge, was make a NWC inspired cartridge using our own properties, the code was ours, as were the graphics. More people should follow this model instead.
    Each one of these breaches is only going to make the actions worse for the future.

    They knew the risk of setting a campaign like this would catch Nintendo's attention. also it didn't help that they were charging triple figures for these reproductions in which even if they did successfully go through this what makes you think you wouldn't get a defect and you screw yourself out of 375 dollars!

      Looks like a knockoff from AliExpress for just the grey one is basically $150. 1upretro is selling both the grey and gold carts reproductions for $130 each. So their pricing for this KickStarter is nuts.

    To be clear, it is *trademark* that you are required to defend or possibly lose. Copyright allows the holder far more leeway as to when they enforce and when they do not.

      They also protect two entirely different things. Copyright protects original "creative" works while trademark protects branding/slogans/product names and the like.

      @@Clownacy I agree. But atleast here it's not the same. Both of those have legal authority under existing laws to repurpose content so long as it aligns with the requirements of the fair use act. These guys straight up were selling Nintendo's software without authorization, and using enough of their IP imagery (enough of Super Marios' trademark likeness to be legally distinct) to promote and advertise a product.... and one they were making a great deal of profit for ($375 per cart). Worse, they had larger retro videogame CZcamsrs promoting the product to possibly thousands of people, and using Nintendo's imagery unauthorized in the process.

    I'm assuming this was a form of advertising. They put up a very public Kickstarter, got a bunch of people talking about, got Nintendo shutting them down, which will inflame a portion of the retro audience to blindly support this despite the maaaassssssive mark up over standard repro pricing. I would not be shocked if in a few.months these start getting sold "under the table" as Pat and Ian put it, i.e the standard way repros are sold.

    On the one hand, this is obviously stupid and illegal (not that I mind NWC repros either). That they thought they'd get away with it was hilarious.
    On the other hand, Nintendo could make their own since people clearly want it. They've got the deluxe edition of the NES World Champs on Switch that comes with a pointless fake cartridge.
    We've seen recent homebrews and repros, and even releases from companies like LimitedRunGames - is it really so hard for Nintendo to make one when that's the whole damn point of their new World Championships deluxe edition? For the price difference, it damn well _should_ be a working cartridge.

      And Pat and Ian have both stated, why even do it when you know what will happen? They commentsd on that one pokemon uranium game that someone was making acting like it wouldn't get a C&D. They redid the game to be legal. Sega has done it before they exited the market. Sony has done it. Square Equnix has done it. People act all surprise pikachu face about it.

      @@Krushak8888 It wasn't "remade to be legal", it was BUILT to be able to get around C&Ds (by making its installer go fetch the game and future updates from a private source, and throwing various versions of the installer out into the wild before going to ground.
      Believe it or not the Pokemon fangames community learned their lesson from when Pokemon Prism got C&Dd
      Which, smart move, team, that'll be a reason why I'd accept an installer for a literal RPG Maker VX Pokemon Essentials mod.

      That's why they had a legal case, on that and ASM2R: those would actually cause a loss in revenue (they C&D'd ASM2R right before announcing their official Super Metroid 2 remake, which, fair enough. (ASM2R basically had the worst timing and an unfortunate spotlight shone on it.)

    The CZcamsrs that promoted this only care about being the first to post a video about something new coming out. There's a certain group, where you'll see one post a video on something, then a few hours later or the next day, the other person will post a video on the same thing. It's like a race to see who can get there first. They don't care about the actual product, only views.

    Only trademarks need to be protected to be retained. Copyrights don't expire until Disney says they do.
    Nintendo doesn't mention Tetris because it's owned by The Tetris Company; Nintendo is just the licensee and publisher. It's why we're stuck with Panel de Pon instead of the way more adorable Tetris Attack on NSO.

    9:15 Just a note you have to enforce and defend trademarks, or there is a danger of them becoming generic. You DON'T have to defend or enforce copyright, you either have it or you don't. For example . The song that was sampled in 'Down Under' by Men at Work had not had it's copyright enforced for decades till someone bought the rights and sued them and won.

      This things are simply for the love of games and preservation etc and should be done in the shadows so big corpos won't destroy them.

    Nintendo historically has only taken things to court when the c&d doesn't work. When they have to go to court though, they will hit you with everything. If they can find a way to turn it criminal, they will. They will sue for 1000X what their "anticipated losses," would have been, even though they have no intention of releasing anything like it. They'll go for disgorgment of revenue and legal fees.
    If they send a c&d to you, give them what they want: they have not lost a case since the 90s.

    Its a head-scratcher for sure. Nintendo is notorious for shutting down anyone trying to make a penny on their brands. And currently, Nintendo is trying to hock an empty gold cartridge preorder bonus for their Switch version. Its like a kickstarter trying to make them look bad/worse

    I would try not to worry on the book front. Like you said, they have a dedicated team to handle these things, they can’t operate in gray areas. They can’t get ‘in their feelings’, for legal reasons as well as others. Consistency is key. If the books were good before and in good faith it doesn’t help them to be willy nilly.

    There are a couple ways of looking at this for Nintendo doing this:
    Against: Nintendo is realistically not losing out on anything here. They're not making any 35th anniversary cartridges themselves, that will have it's potential revenue stream bit into, they're not doing a virtual download that's customizable that is having it's potential revenue stream bit into & finally it's not even the full games, basically still previews of 35 year old games that are also pirated on a million sites. Had this been a "Why prove you're the best at one level, prove your the best at the entire game" so all three games were included I could get it but not one level each still.
    For: Whether we like it or not it is still their intellectual property and they are free to go after whoever they want. We can say it's ridiculous since it's one level but sites that have entire nintendo libraries on it, but this was a money making venture that to an untrained eye could look official. Second the brazenness to put this as a kickstarter and doing a fundraising for a basically pirated game has to be made an example of, because maybe other people would start thinking to do this for other NES games. So Nintendo even though the'd lose no money to this, needed to in their mind send a message of "It's one thing if you do this on chat rooms and obscure sites we can't always find, it's another to do it out in the open".

    Nintendo Power had a special issue for the 25th of the NES. Other than that Nintendo focused on Super Mario Bros. 25th anniversary. Special Wii, DSi XL and the Mario All-Stars release for the Wii.

    Yes, yes it should've been shut down. This is a glorified ROM Hack, and there's no reason they need a kickstarter for this. Really poor timing to be trying this when Nintendo themselves are doing something with the NWC too.
    If the guys wants to just recount their experiences, write a book or something. That would be fine to kickstart.

      @@Krushak8888 They really could of made their own similar games. Game mechanics can't be copyrighted to making a clone of Rad Racer and Tetris would of been not difficult. Super Mario Bros would need to be changed up the most. I guess it does rob it of some of the appeal of playing games you'd be more familiar with, but I could still see it being successful.

      @@larryinc64 Nah, Mario is fine to clone, too. Case in point: Giana Sisters did it (the original was jank, but they did do it, and managed to become an actual IP (Twisted Dreams was on PS3 and I think there was one on the DS?)
      All you need is just a reskin and for it to use its own code. (I'd say just drag Giana Sisters in but that's an actual IP now and not a dubious clone anymore)

Could this have been a way to drum up publicity knowing full well that it would be shut down, and then they will find some alternative way to sell and distribute this?     I feel like this should have been distributed as a free ROM patch rather than be distributed on cartridge physically
    sure reproductions have existed for a long time but Nintendo is certainly not happy that they exist and to publicly announce a Kickstarter campaign to fund what is essentially unauthorized derivative works of Nintendo's property than no wonder the big N was quick to shut this down but if this were instead a ROM patch where you'd patch a ROM of the competition game than Nintendo probably wouldn't have cared since free ROM hacks tend to not really be targeted especially compared to projects that are asking for money

    If they hadn't provided the original data, they'd have been legally in the clear. If it had JUST been the cart and the patch that included ONLY their own original code and assets (ROM to be provided by the customer), everything's as legal and above board as all those unlicensed expansions to games sold in stores back in the 90's/early 2000's, like the Insurrection expansion for Starcraft. But, no, they included the original assets and had NO legal defense available.
    Of course, Nintendo would have shut them down through sheer weight of legal fees anyway, but at least they'd have been on the legal and moral high ground.

    Now to play conspiracy theorist, what if they didn’t want it to come out? I don’t know enough to think this is the case, but here are 2 thoughts I had.
    1. The Rom didn’t work, or there was difficulty somewhere in the process. They then put up the kickstarter knowing Nintendo would surest cease and desist and they can move off the project, and become one of those things like AM2R taken away by Nintendo.
    2. Use the publicity for the actual venture. This project was always have a limited reach, but if they now change it like past Sonic fan games have in the past they could expand their market, and be ‘the game Nintendo didn’t want you to play’. Hard though with Tetris, as people could make a serviceable platformer and racer, but nothing but Tetris feels like it.
    Mostly likely it will end up as incompetence is my real guess, but thought I should throw wild speculation out there as well.

    Mihara...Sucks....Hancock....Sucks....Auckerlund....Should have known better....CZcamsrs that try to profit on stuff like his....Shameful!
    Hancock still does not have his museum up yet while taking in a ton of revenue, while there are some examples of no-name media personalities that spent tens of thousands of dollars of their OWN money while not making any revenue at all and still got a museum up, albeit briefly in the midsts of the worst pandemic we have had in a century. Shameful.

    What I want to know is. Are people going to get their money back since the kickstarter it was cancel by Nintendo ? I say give back the 20 thousands dollars or whatever was collected before Nintendo kicked the door in with the blood sucking lawyers. 🚪

    As they should. The level of work they put into their games is insane. The fact that they can completely develop games without even a rumor of their existence ever getting out, anywhere, is a tribute to their culture. People randomly showing up, trying to make money off their work and blatantly using their character(s), trying to skate around their trademark by calling it "NWC" instead of Nintendo World Championship... all while using a very similar logo..... yeah, how about no.

    I wouldn't call this either a _"kerfuffle"_ nor a _"Good idea"._ It's a shady venture, for a several hundred dollar bootleg without Nintendo's Authorization. A Product with Nintendo's name literally on the label, and being promoted by people for whom seem to have no problem profiting off of what many are claiming is a scam. This product was also promoted by friends of you guys, JohnRiggs and John Hancock. It doesn't look good for any of them involved (not that I'm directly connecting either of you to this kickstarter).
    Furthermore: for a unlicensed reproduction (I don't care how you rebrand it as a 'Anniversary' product) - that they are still making money on a crowdfunding site off Nintendo's imagery, IP, and a software - these fools were asking *$375 DOLLARS!* That is as much as a modern console, for essentially content they [stole] do not have legal authorization to reproduce. That is $375 for a repro of someone else product, in a $10 shell and maybe $30 of packaging and extras. They were counting on collectors to snap them up for the absurd price, and then hold on to them hoping they would become valuable in time.
    So call it what it was: it was allegedly a SCAM - and even if they legitimately were going to ship out product, they advertised, sold, and profiteered off the transaction knowing they had no legal authorization to reproduce it. If I was friends with some of the people who promoted this, I wouldn't make excuses for them - I'm a good person, and what they did was slimy and wrong (right is right, and wrong is wrong). I don't care if it was my own mother. Everyone involved should be ashamed for asking that much for this, and doing it thru a public crowdfunding and shamelessly using someone else's intellectual property without their permission.
    For shame on anyone playing defense for this product or those involved. It got pulled down because outside those people and their friends, the majority for the world saw this for what it appears to be. If this was actually a "good idea" then get back to me when Nintendo actually licenses this to them, and we can talk. Otherwise I will not treat these people the same as some guy selling $20 repros on eBay under a random handle. This was PURE GREED.

      @@Krushak8888 most of the malls I've seen them being sold in tend to be in small blue collar towns where they would be less noticed as well. You probably wouldn't see them being sold at the mall of America or whatever.

      @@pacmancdi but that is what I am saying, its like when people get upset that some con wont let them sell fan art of popular franchises cause it got noticed.
      Your not going to notice some rando vendor in the middle of the mall(doesnt have a store front) and probably not worth it. Again, most of that crap you can order from alleyexpress or other places that is China, Korean and etc. Which have no IP laws. Thus its much harder to stop it.

There years and years of fairly high profile controversies there - not that I ever ordered from them myself, so I don't care one-way or another. I only what I am saying here, because those controversies were so magnified here on CZcams.

    I'm glad Nintendo was cool about the books, but I think a lot of people would disagree about how fair they are. For instance, shutting down private online Melee servers to stop an unofficial tournament during the pandemic and whatnot. For this instance though, yes they were just asking to be shut down.
