    Check to see if your contractor is “bonded”. This might be on the license board’s website. It is essentially an insurance or escrow for the homeowner if the contractor breaches a contract. It is also known as a “surety” and doesn’t involve a lawyer.

    Going through this too. Over 1000 is a felony . So I’m currently working with the county attorney and this can’t wait for Justice. The last straw over him taking 14k and giving me a 2k floor that was crappy work anyway. Was he took 1709 from me for a sink and dishwasher and never came back. Refuses to give my money back. FELONY

    We won a $10,000 judgement in small claims court. Since we are in Alaska, the court garnished the contractor's Permanent Fund Dividend check. Attorney is too costly and can't squeeze blood from a stone, small claims court is faster and does not cost much.

    If you get burned by a contractor then go after their bond! Can’t believe this wasn’t even mentioned in this video! Most licensed contractor’s are bonded. Get their bond info off the contractor’s state licensing board website of the state you reside in, then contact your contractor’s bond company and file a official complaint! The bond company is obligated to look into shoddy work or business practices that were completed. They will assign you a claim number and an adjuster who will investigate your case. This is all at no cost to you. The bond company will issue you a check and then go after the contractor for reimbursement. If the contractor fails to comply or fails to reimburse the bond company, his bond company will pull his license. Either way you’ll get what’s owed to you via his bond/surety company. You can also file an official complaint with the CSLB where his license could get suspended. Waaaay better than hiring an attorney that’s going to cost you a fortune!

    #1 review the work done and if there is work completed that requires a permit and one wasn’t pulled then report them to the local licensing agency. They can hold their feet to the fire and if they don’t perform they’ll lose their license and be ordered to pay restitution. going this route is the quickest and one of the best ways to get the intended results with little to no out of pocket expenses

    I used a contractor who was on a list of from the city and got burned, not really sure where to go from here because a few yrs have already passed . Just have learned that it really doesn't matter who recommends who, everyone must still do their own due diligence regardless.

      So as an update to thus post, turns out the contractor just reached out to me a few days ago. The property that we had him working on might be eligible for migrant housing. So now we are looking into how everything can be structured to do so. Maybe things will turn out better than before...time will tell 🤷‍♂️

    If homeowners actually paid good money and hired reputable company’s/contractors then they wouldn’t have this problem. Unfortunately, most homeowners are going for the chucks in trucks and then question why they got burned at the end. 😂

      They expect a job to be completed per the contract and what was agreed upon. Contractors in general don't work hard and expect too much for sloppy jobs.

    Why does the cash on cash return fluctuate like you said ?

      Great question @DavionSavant. Cash on cash fluctuates based on available cash flow, refinances, and expenses. For example, the first year's cash flow might be 6%, if rents increase on the property, the second year might be 7.5% cash flow. Therefore, it can change every year. In the third year, suppose you have a refinance in which 25% of your original investment is returned to you, that would make the cash on cash increase to 25%+ in year #3. The preferred return simply means that the LP investors are paid the first ___% of positive cash flow from the deal before the GPs start sharing in the profit. Therefore, it does not change throughout the hold period of the property. If a deal has a 7% pref, then the first 7% of cash flow (every year) gets paid to the LPs each year before the GP can share in the profits. Hope this helps

      ​@@Davion_savant As an GP or an LP, I would be conservative. If you have a pref that is too high, the GP may not make money. As an LP, I look for firms who under-promise and over-deliver and who underwrite conservatively. I'd rather have a 6% pref on a conservative deal vs an 8% pref on an aggressive deal. Keep in mind that a pref is not a requirement on deals. Many GPs do not offer them, they are simply a way to entice LPs to invest.
