Davita dialysis center has not proved their claim against patient. In October 2018, it (same medical group) agreed to pay $270 million to settle allegations that it violated the False Claims Act by providing inaccurate information that caused Medicare Advantage Plans to receive inflated payments. Seems like Davita associates would be more reasonable and careful of policies concerning potential false claims of any sort. According to police; Gene was not charged. We already know that Davita has a record; and have been charged with making habitual false claims; according to Wikipedia. / Also Emergency staff has said Gene is not presenting imminent danger to himself or others. In fact he said he is praying; that such things never happen ( using nonstandard double negative for emphasis). Easy case for another class action settlement against Davita. We can all agree that Gene was the only one praying in the room for sensible routine care. Accusers now need to be investigated.

Whoever is helping this man make medical decisions really doesn't know how the system works. With his age and medical insurance he can receive dialisys at home. He may even be eligible to get a personal one that hooks on to you while you are asleep.

I have a long comment I consider to be crucial, I would appreciate any critique or comment - I hope you can respond. I have serious spinal nerve damage, and I used fentanyl patches, AS PRESCRIBED BY THE DOCTOR, for seventeen MANAGED years without a problem. EVERY SINGLE OVERDOSE IS CAUSED BY BOOTLEG, LIED-ABOUT, BATHTUB FENTANYL. A most obvious, public example? (Musician) Prince died because he WASN'T getting prescribed pain killers. Yes he overdosed, he was clearly on thin ice, hovering in a crisis mode; BUT when he got hit with the NARCAN, it had TWO effects: A) saving his life, and B) throwing him instantly into full-blown opiate withdrawal, after YEARS of daily use. OF COURSE HE ONLY KNEW ONE WAY TO FIX THAT. Narcan is EXTREMELY dangerous that way. In retrospect, he could've/should've been arrested or held at that hospital and shoehorned into a safe, controlled withdrawal management plan. But, he WAS a spoiled rich rock star. However, not ONE GODDAM PERSON talks about how dangerous Narcan CAN be, both physically AND psychologically. Now, I have weaned myself off the fentanyl patches earlier this year (NOT easy). I was using the 100mg patches changed every two days. Although I do carry serious pain around, I realized I'll be dying soon enough from my collapsing discs, and I feel adamant about being sober for it.But there are some SEVERE MISTRUTHS, actually KILLING people, some deceitful blather repeated so often by every so-called expert as to acquire the stench of truthiness. NUMBER ONE: The vast, overwhelming majority of people die because they're trying to get high. And they buy dope from dope dealers! The actual percentage of people who's "trouble" started because of an overly-lenient doctor's prescription is TINY, way under TEN PERCENT, more like three percent maybe. Stop lying about this! Stop blaming the doctors! Nobody can SUPPORT that "lazy doctor meme" with actual evidence - ask them to NAME a NAME - no one CAN, because it's bullshit! It's not real, didn't happen, maybe your gran-mama is out hooking on the streetcorner - but it's NOT the doctor's fault. NUMBER TWO: the vaunted "strength" of fentanyl matters not a BIT if you use prescription drugs as instructed. It's a safe medication!... used as prescribed The strength of the BATHTUB SHIT matters hugely because dope dealers are sloppy, stupid assholes who'll do anything for money. NUMBER THREE: Narcan is quite dangerous as currently flobbed about. It's just handed out to any old body with NO information about the consequences of sudden, full-blown opiate withdrawal. I haven't found statistics, (perhaps it'd be discomforting?) but I pay attention and I AM SURE more people die from the roller-coaster induced by Narcan than from all the LEGAL fentanyl and oxycodone prescriptions combined. What do you actually, possibly, expect a dope fiend to DO if you blast them to a total, screeching zero-blood-level halt? What else CAN they do but go score something quick?!? NUMBER FOUR: In looking at DMT, LSD-25 and such, it's obvious that the U.S government can and has gone deep into the markets in China and Mexico and slammed down on the precursor chemicals needed to make acid - hence if you can figure out why the U.S. is awash in fentanyl and crystal meth when the government COULD STOP IT DEAD if they cared to? - well, let somebody know, huh? AND NUMBER FIVE, ("Mr. Popularity" rolls 'em): all those programs which attempt to treat alcoholism always involve some component of analysis of a person's URGE to and/or NEED to escape reality. And they also purport to DEAL with those causes. But I have yet to hear of ANYbody, ANYwhere, ANYexpert even pretending to care about why so many millions of people are willing to daily risk DEATH-BY-FENTANYL because of the monstrous suckitude of their dismal lives? WHAT ARE YOU DOING TO YOUR FUCKING CHILDREN?!? Am I the only one who knows we're not, actually, going to achieve a whole lot until THAT issue is faced square-on and honestly?

If they have due process to take you off food stamps, if you have health insurance and you go to a federally assisted medical facility for life-saving care, you must get due process before they can sentence you to death… He’s old. We’re all gonna get old and say crazy shit as our medical system gets increasingly awful, and I don’t want some person who just doesn’t like me to be able to make up some claim that I said something and they automatically take that persons word over mine because I’m old and they’d rather not pay to maintain that machine for me anyway. This family needs to sue for malpractice. They cannot do this. He has a right to substantive due process… it doesn’t matter davita is private, if they accept Medicare, they are federally assisted. And by the way, not even an employer can blacklist you. This is actually criminal.

Why didn’t the medical staff institutionalize him? If unemployment and snap have to give you a hearing for due process before depriving you of those benefits, an established patient who needs live saving care should have a higher level of due process protection.

This happened to a elderly man I know. He had a stroke with frontal lobe damage and he also has slight dementia. Well he said a few things he shouldn't have to two female nurses and a few times he grabbed their arms in anger when in extreme pain. They put him on tons of drugs which also make him unable to control his behavior. They make him act drunk. So he got discharged with absolutely no care. Sent home to be taken care of by his 80-year-old wife. Hospice wouldn't even step in until the month changed over. I'm surprised he survived. He's still in the same situation on hospice being taken care of by his 80-year-old wife. In some ways he's a lot better off because she only has him on one medication other than pain medication... In hospice is forcing her to have him on that medication, but she thinks it makes his behavior worse instead of better. But he does sleep for a couple days when she gives it to him. 🙄
