Post NAR Settlement Implementation Update with Mark Messimer & Robert Bustamante
(24:41) The NAR settlement rules are now in effect. When representing buyers and sellers, you need to be familiar with best practices for describing seller concessions as well as executing buyer-broker agreements.
This MLSListings video provides the guidelines you need to stay compliant with these and other recent industry changes. Mark Messimer and Robert Bustamante, Directors of Outreach and Compliance, explain the background and application of changes in response to the recent NAR settlement. They discuss when the use of language about concessions on the MLS implies compensation offerings and what wording is allowed in public and private remarks.

    Sale Concessions are not entered as much as they should be, but they are entered by some diligent agents. Moreover, this data is a good source for us valuators and a critical metric in valuations. In the same manner, other critical data must be mined, since it is not readily available or prompted at time of listing. I wish income data or at least monthly rent was entered more often too! Maybe if property is tenant occupied a monthly rent would be prompted, if not required. Same with attached / detached homes. Some of these easy prompts could at least cut down on all the cloned listings, where the listing agent uses another prior listing when entering into the MLS; except agent forgot to "uncheck" that box. If only I could parse the MLS LOL. Thanks for keeping us up to date everybody!!

      @@ItsAllAboutYouRE Yes, if we have a property go into contract before 8/13 and we have a dispute about the buyer commission then we want to make sure that MLSListings can view the data that existed pre 8-13.

    We win in the negotiations when we solve the needs of both side, it is often the soft unspoken need of both the buyer and seller . P have had a buyer clean out the home of an elderly woman after she took what she wanted she was morning the death of her husband and the buyer could see her need he also had a timeline to meet so he and his boys solve the challenge with a solution wrapped in love. As agent we weave needs and resources of buyers and sellers.

    my report section just spins and never loads. on the off chance it does load you cannot click on the information and the report is very limited any chance they'll expand the reports to have pie charts, graphs and more user friendly info?

    Enrique said it clearly. There was a mentally ill homeless man sleeping in the left turn lane. How does affordable housing address unemployable persons with mental issues? These folks can not participate in paying rent or taxes. How does imposing COPA on property owners solve this issue when it makes the cost of ownership much higher than before? I would suggest the city of San Jose look at the city of Reno, NV has been successfully dealing with and solving its homeless issues. COPA is another disincentive for investors (mom and pop) to provide rental housing that is much needed.

    Regulations created the problem. Adding more will only make it worse. The moment you create a regulatory agency is the moment "corruption seeks" to possess and control it. Right now... the law "heavily" favors large enterprise keeping and holding vacant properties by allowing them to get tax breaks or write offs. Housing is a critical issue... it really needs to be a serious financial burden to possess "unused property"... especially when there is insufficient inventory. It really encourages destruction.
