This guy clearly states (twice) that you should NOT have witnesses to your holographic will, or have the holographic will notarized, but he does not provide any reasoning or justification for this. This is in poor form and discredits his advice, regardless of his beliefs. Witnesses and notarization confirms/proves that the will was in fact written by your own hand and is not a forgery. It also provides compelling evidence that the will was not written under duress, and that the writer was of sound mind at the time of writing. No witnesses, and no notary, therefore, implies the very real possibility of a forgery or false document. In other words, without any witness or notarization, the will has no credibility. The beneficiaries are then burdened with providing additional documents to prove that the will was in fact written in the persons own hand. This however still does not prove that the will was not perhaps written under duress or force, or that the writer was of sound mind when they wrote it. Update: after inquiry to an esteemed estate lawyer, they were clear in stating yes to witnesses and no to a notary. Unfortunately, no reasoning was provided. I trust this advice though, so that’s what I will do-witness, no notary.

I do have a troubling question that I am currently facing and would love to hear your answer based on the following facts: Decedent passed away intestate. He left a young wife and one young child (three other adult children were left from a previous marriage). He married his most recent wife in Mexico to avoid having to pay an attorney for a prenuptial agreement. Apparently, in Mexico, on the date of marriage you can request that the marriage certificate contain a clause that states all marriage assets shall be deemed separate property as opposed to community property. After the marriage to his new Mexican wife, Decedent purchased a home in California as an "unmarried man". He lied when he purchased home because he purchased it as an unmarried man when he was already married. He apparently did so in an attempt to keep his home as his separate property. My question now is whether the home purchased in California by the decent during his marriage with his Mexican wife is deemed or will be deemed his "separate property" or is it or will it be deemed the marriage's "community property"? In short, does the Mexican Marriage Certificate control and determine the nature of the property even though Decedent purchased property as an unmarried man when he was actually married? I am assuming that if the property is deemed surviving spouse's "community property", she should receive 50% of property's appraisal plus 20% share from decedent spouse's separate property. If the property is deemed decedent's separate property based on Mexican Marriage Certificate, only one-third will go to surviving spouse with the remaining two-thirds to be divided amongst four surviving children. I am planning to write a short holographic will naming 3 items (cars, boats) for my nephew. Other items such as CD investments are already filled in with other beneficiaries on each perspective financial institutions. Can someone confirm the CD items not going to be in conflict in this holographic will (vice versa)?

Does having 2 witnesses invalid the holographic will? Or, is it just not necessary? It seems that 2 witnesses, although not necessary, would not necessarily harm the wills validate, but would reinforce it if questions come up. At least witnesses can recall the creation of the will, state of mind of the creator, etc.

We never got any letter from the Trustee after my dad's passing. What he did tell my family in person after the funeral was, " Dad made me Trustee and Beneficiary of his entire estate and I dont have to notify anybody about anything and I don't have to answer any questions." And then he walked away. The estate was over a million dollars plus 4 or 5 houses dad owned, plus a safe depost box and several annuities. My dad had a last will and testament for decades. It was after my brother obtained power of attorney that quickly put everything in a trust, made himself sole heir and Trustee. My dad was scared to death of my brother.

If a Living Will was drawn in 2007 and a Trustee designated, understanding the Will is exempt from Probate, How do beneficiaries change trustee designation if Trustee had been diagnosed with terminal illness and is mentally incapable to perform as Trustee in 2018? Parent died n late 2018, and forgot to change Will Trustee before death.

f you have full authority under the IAEA, do you have to wait for the appraisal referee to return the form regarding the appraisal vale of the property before you can sell it?

great video. if the probate only include a real estate property with value around $260k,as is, reverse mgt $218k going up $1700 evrey month. if a probate is se the beneficiary will net after all cost maybe $5k probate fee + reverse mgt add up, closing cost and real estate commission.. Does a probate still need to be done to transfer the asset? Thank you

EXCELLENT information. We already have the Letters of Admin., and we have them now. So we wait the four months and will follow this guideline. Thank you so very much. This is a simple estate, so it should not be difficult. The first part was a bit challenging. But we did it. However, it took far longer because we didn't really know what we were doing and we had to go to court FOUR times to get the administrator approved. We did it tho!! If I had found this video 8 months ago, I don't think I would have understood any of it. But now I surely do.
