Medicaid and Crisis Care
www.lavin-elderlaw.com
A big way to handle crisis planning is through certain benefit programs, mainly the Medicaid system. Medicaid can help cover for home healthcare, assisted living, all the way up to skilled care. But Medicaid is a needs-based program.
I always say it's a three-part test: You have to have an illness, you can't have too much income, and unfortunately you can't have too many resources. Now, people are constantly told on the computer that you have to spend everything down to almost nothing. You'll see the $2,000 number all over the internet. Well, that is Ohio's preference. And they will let you spend all the way down to nothing if you don't know the rules. Our job is to be on equal footing. And we have to know what resources are exempt and what resources are exposed.
The Lavin Law Group, LLC was started with the goal of representing clients in a way that maximizes their independence and minimizes the stress and burden placed on loved ones. Our clients come to us from all walks of life. We have clients in crisis and some who are just approaching retirement. However, all of our clients have one thing in common: each and every one of them was smart enough to develop a personalized estate plan for the preservation and protection of their wealth.

Disclosure how? If assets were given to adult children prior to qualifying for medicaid for longterm care facility, how should that be disclosed? Disclosed to Medicaid?
NO NO NO DONT EVER GET A GUARDIAN THEY ARE ALL.CROOKS AND ONCE THEY ARE IN YOU CSN NEVER GET RID OF THEM. THESE LAWYERS AND OTHERS ARE ALL LIERS .DONT DO IT.
Better than a deputyship.!
Depending on what state Mom lives in, the state might come after children's and even grandchildren's assets, to take back whatever was paid by Medicaid..
If family takes assets to qualify them for Medicaid, there can be problems
“ Ain’t that America , home of the free “. Remember our corrupt government doles out almost a $1T to the Pentagon in wasteful military spending funding forever wars. Just a small fraction of that money would go a long way to resolving the assisted living crisis
Oregon, here I come!
Mom "lived" to be 99. Why?
Case worker apply for Medicaid and Medicare.House will have to be sold if reverse mortgage.
Why would they bother to have a "Medicaid bed" if they can just milk fresh cash paying customers?
Open beds
Does this mean you should inquire upon the initial admission whether or not the facility accepts Medicaid and also has a Medicaid room(s)?
Yes and families don't step in to assist - a million excuses and their commitments.
They dump them off in front of a homeless shelter in the middle of the night. Facilities have already been caught doing this!
Are you kidding me😮
@@lindaguida4074 I've seen it, when I was homeless. And they don't even ask whether the shelter has a bed.
@@lindaguida4074 No, they're not kidding.
Don't worry, my wife and I are not rich. But both of us still pay income taxes in our retirement years. A small bit of which goes to take care of others people's Mom's. Which is ok. We only worked hard and saved because I'd rather go to Oregon and do legal suicide than live a single day in a Nursing Home. Sincerely. A relative put his healthy 90's mother in one and then sold her home for the past 52 years. I visited her Medicaid paid Nursing Home. What a horror show. Cheaper flights to Oregon when my time comes.
What’s a Medicaid bed. Sounds like a cot in the corner of a room. SMH!
Worse, it's an old urine soaked mattress on a hard floor. Medicaid pays next to nothing so no one wants to accept it. CMS requires certain nursing homes to allot for a small number of beds dedicated to poor Medicaid seniors. They are horrible distopian hell holes not unlike the insane asylums at the turn of the 20th century.
in some places it's 3 to a room. Most medicaid facilities smell like feces and urine, typically everyone is in a wheel chair and pushed infront of a fish tank or bird cage for the entire day or they sleep 20 hours a day.
They'll put anyone who can't pay out on the street, Believe me ! It's the meat and the money honey !

This country treats its elderly like garbage and no one fights for them. It’s appalling.
I had to appeal their decision to stop paying 15 days after my mother had hip surgery. I lost the appeal.
Good afternoon sir; I came to this country in 1987 because of the American dream. I was living in New York, and back then We decided to move to New Jersey and boug house in central New Jersey in 1992. Both my mom ,I and my name is on the mortgage. When we moved to New Jersey in 1992 I was the one paying the mortgage all along because my Mom was not able to pay because she was a Home health aid worker making minimum wages even though she tried, and she was not in the very best of health all those years because she was not in the very best of health my Mom developed kidney disease, sometimes in the late 80s because she had very high and blood pressure, and in the late 90s it got worse, and then she went on dialysis for over 20 years sadly she passed away last year in August. Because her name is on the title along with mine Medicaid put a lien on the house for $300,000 and all my life's work and savings are gone for 31 years I paid the mortgage by myself and now I lost most of my life savings in this house My only child was born in 1992. 2 months after we moved here, and this is the only home she knows, her grandma raised her from birth She went to college got her degree and paid off the house last year and she was, She buried her grandma buy her headstone and my daughter spent thousands of dollars paying off the house and burying her grandma both she and I are disinherited she got nothing. Now she is out of her mind, and she moved out and was in the hospital she does not speak to me anymore I only found out that she was In the hospital when she came out she did not take my calls or answer my texts I have diabetes and high blood pressure, and the stress is hurting me I cannot sleep sometimes. They violated my property rights they should charged us what we could afford and would pay it over the years My mom did get public assistance we are not denying that, but we believe that they should be more flexible with us They just will not listen to us so both my daughter, and we are denied our human rights thats what I believe, but as I am not a lawyer I cannot say too much because I don't know the laws if I sell this house I would walk away with less than half and at 65 years old I lost my life savings in this house my retirement money has been gone for 31 years I rebuilt this house, and now it needs a lot of work that I cannot afford I really would like your advice and how to go forward, I don't know how long I am going to live through this situation please I need help advice if I have rights or not

Medicaid is socialism.
It's welfare under capitalism
Where do they put people with alcohol problems that can't be taken care of at home by family?
You may be liable under old family obligation statues, if you sabotage a Medicaid application.
Treason from stealing my estate and medical identity and altering my medical records and stealing my inheritance and deleted my dissertation records with my sociopathic family.
Guardianship stands for steal elderly persons money.
I am my mom's guardian because my brother was stealing thousands from her. Not all gaurdians steal. Not all older brothers are" stand-up" fellas.
Need to find a form of guardianship that prevents investment-decisions(larger amounts of money) without taking over finances with POA due to conmen and scammers and investment-bankers and insurance-linked-sales and ... ... social with neighbourly "investment guru"
Is the recovery only in effect because the person resided in a nursing home facility?
What if my grandma can't write when so so far in her altimeters
My grandpa never learned to read
What about the estate then will I need a gardain ship
Long story short; it’s a long laundry list.
I have received inheritance under the current asset limit of $130,000 for medicaid in California. I am also turning 65 in November and have to notify them to change me from SSDI to retirement benefits. I make under $1,700/mpnth currently and am on the Medicare Savings Plan which pays for my Medicare Premium. I am trying to decide what to do... whether I can remain on MediCal with QMB extra help or to go with a Medigap plan, as this is the only time I will be able to get coverage for the future without going through medical underwriting. I know this will be expensive and am weighing my options. I may no longer be eligible for the medicare premium assistance, as I think the asset limit for MSP is $8,400. I found this out too late, however, as the money is in my account. I don't want to get in trouble and lose what is supposed to sustain me for the rest of my life. I have until May 2023 to make this decision. Also, if I am below the asset limit for MediCal, do I have to report it within ten days? I was informed that I only have to report it when they do a redetermination at. year end or when I change to retirement benefits. I am under a great deal of stress trying to make the right decision. Will I have to literally spend the mpney I have received on health insurance?
We were told that we could have 28 hours a week of in-home care for my dad from the VA. We just brought him home to live with us five weeks ago. Unfortunately they are having trouble finding home healthcare aides for our area. Thus, we have been caring for my dad‘s solo without any of the help that was allowed. I did ask them about whether or not we could get the money that would be going to the home healthcare aides since we are not able to find any for our area through the agencies that they are using so that we could possibly find someone else ourselves. I’m hearing you say that the money could actually go to the family? Should I look into it more? Thanks for any help.
No I don't need a guardian ship can what should I do with the guardian ship
I am my moms gaurdian, and I am protecting her from my brother, who was stealing thousands from her.
🤨🤔💭🗯> Living with Social Security and Medicare ~ Medicaid only in a Nursing Home at 74 worries Me, seeing these advice sites on CZcams‼ 🙁☹😠😤😡🤬👎👌👀💯Yup❗
This country sucks
So what’s the point to have Medicare
Not to pay nursing homes.
Specify the goal and need money
I thought that guardianship over rides a poa...
It does....
My aunt is my mom's monetary POA and I took over her health care from my other aunt because she lives in another state.
Excellent quality video! Thank you. Question... I loaned my aunt money to pay off her home mortgage. I had a promissory note completed and used her home as collateral. I'm have a first position lien. There are no other liens on this home. If my aunt goes into a nursing home down the road and Medicaid places a lien on her home will I be paid in full before Medicaid?
There was NO sound when the man is talking!
MEDICAID covers long term care for nursing homes
If you’re poor. Otherwise the nursing home will suck you dry after 100 days even drive you into destitution. That’s your great America.
Thank you!
Thank you!
I once believed Alzheimer's disease has no cure.. Well, it is true with western medication, but not with herbal medicine. My Dad's experience opened my eyes to the reality of a cure through herbs.. My Father was diagnosed with mild dementia in 2013 but now he's finally free with herbs from Dr. Rohan.. You can reach out with the doctor via dr.rohanronjohn@gmail.com
My mom was diagnosed with mid dementia in 2016 and now she is completely free from dementia with Dr. Rohan's herbal supplements.. you can reach him via dr.rohanronjohn@gmail.com it may also help you
if medicare gets people off the “dole”. we need to move them over to the welfare dept.
