I understand why AMV videos can be problematic from a legal standpoint. Often, people download copyrighted music illegally and use it in their videos without obtaining permission from the artist who created the sound recording or composition. This unauthorized use infringes on the artist's rights and can lead to legal consequences. As an artist, I actively monitor the web and take down videos that use my work without permission. I do make some exceptions, such as allowing reactions, criticism, and parodies, as they generally fall under fair use. Additionally, I authorize the use of my Sonic Frontiers FAN OSTs in mods and gameplay videos featuring these mods. Beyond these exceptions, any unauthorized use of my music is considered copyright infringement, and I don't hesitate to take down such content immediately. To address monetization issues, I created a separate channel for remixes and remakes that aren't eligible for monetization, while keeping eligible covers and original tracks on my main channel. I always ensure to get the appropriate licenses before making covers. I urge everyone to make sure they have the necessary licenses before using any copyrighted work. Respecting the hard work and rights of artists is crucial.
Interesting take. I agree when it comes to small artists/musicians, but when it comes to mainstream music from larger record companies it should be fair game for AMVs to use based on the fact that no AMV is claiming to have created the music that they are using (likewise with the animation itself). AMV editors don’t take music and claim it as their own work but rather put a spotlight on it giving credit to the artist, so it’s very different from say copying a piece of physical art. I liken it to a dance company when they choreograph a dance for example, of course they didn’t make the music but in order to make their art (the dance) they need to use other art (the music). I feel it’s more of a collaboration of art that doesn’t take away from the music’s artist. Therefore I find the entire copyright process for CZcams stifling for content creators in certain areas such as AMVs, and I don’t think they should be lumped in a category along with people who might take the music/art and copy it or claim to have made it. Also, the amount of music from smaller artists that I have found from AMVs that I otherwise would never have heard about is extensive. I would imagine that as long as credit is given where credit is due then a smaller artist would love for others to enjoy and share their work. ✌️
