    I’m taken aback, disgusted really by the way a public official would lash out at someone who has volunteered for years and rendered service to the city. It doesn’t matter if you have disagreements. This display especially from a city official is inappropriate

    At one point it is offered that "We've got a lot more population, a lot more cars too !" - "We've got a lot more volume coming thru that intersection." According to US Census Bureau, Albany's population grew 6.1% from 2008 to 2016. That's not what is generally considered "a lot more". Also when coupled with the fact that (as someone else mentioned) some people simply choose to avoid that intersection altogether - which could well be a contributing factor to the business failures near that intersection since the Photo Red Light program was instituted there. One interesting factor on the U.S. Census (that I didn't know about Albany) is that just over 11% of the Albany Voting Age population are Veterans. So we Veterans are a minority, but not as small of one as elsewhere.

    Oregon Statutes 279B.110 (2)(b) & (c) indicates that Redflex should have been disqualified (for at least three years) from consideration of any contracts with the City, based on the Guilty Plea of the former Redflex CEO (who signed the Contract with Albany in 2007) on Federal Charges of Bribery and other charges in June 2015. Inexplicably, the "contracting agency" seeks to bypass the normal process and renew early using the Special Procurement provision of ORS. 2015 ORS 279B.110 Responsibility of bidders and proposers (1) As part of a contracting agency’s evaluation of a bid or proposal, the contracting agency shall determine whether the bidder or proposer is responsible in accordance with the standards of responsibility set forth in subsection (2) of this section. If the contracting agency determines that a bidder or proposer is not responsible, the contracting agency shall provide the bidder or proposer with written notice of the contracting agency’s determination. (2) In order for a contracting agency to determine that a bidder or proposer is responsible, the bidder or proposer must demonstrate to the contracting agency that the bidder or proposer: (a) Has available the appropriate financial, material, equipment, facility and personnel resources and expertise, or has the ability to obtain the resources and expertise, necessary to meet all contractual responsibilities. (b) Completed previous contracts of a similar nature with a satisfactory record of performance. For purposes of this paragraph, a satisfactory record of performance means that to the extent that the costs associated with and time available to perform a previous contract remained within the bidder’s or proposer’s control, the bidder or proposer stayed within the time and budget allotted for the procurement and otherwise performed the contract in a satisfactory manner. The contracting agency shall document the bidder’s or proposer’s record of performance if the contracting agency finds under this paragraph that the bidder or proposer is not responsible. (c) Has a satisfactory record of integrity. The contracting agency in evaluating the bidder’s or proposer’s record of integrity may consider, among other things, whether the bidder or proposer has previous criminal convictions for offenses related to obtaining or attempting to obtain a contract or subcontract or in connection with the bidder’s or proposer’s performance of a contract or subcontract. The contracting agency shall document the bidder’s or proposer’s record of integrity if the contracting agency finds under this paragraph that the bidder or proposer is not responsible.

    Sorry I forgot to mention that the APD request for Special Procurement for the Continued Operation of an Existing Photo Red Light Enforcement Program begins about an hour and 5 minutes into the meeting. It lasts around 16 minutes. If due to some unexpected, unforeseen, glitch causing some or all of this video to become unwatchable, etc. The Custodian of Records for the City of Albany, Oregon should be able to restore a copy from their archives (I would think).

    The unidentified, out-of-uniform, "Lt." made several material misstatements which went unchallenged or corrected. At the beginning he states..."being that we've already gone beyond the current contract..". - which is given as the reason for the urgency to bypass the normal contract bidding process. Clearly wrong. The APD letter (incorrectly) states that it will end ten months later, in February 2017. In truth the existing contract was not set to expire until June 30, 2017 (14 months later). He also overstates the number of accidents at Geary & Queen as being 11 (for the year) . Later when the Mayor asks about the stats and asks is that per month? He says yes. If members of the council voted in favor due to either being misinformed about urgency due to a lapsed contract or because of an overstated public safety issue - then the Council needs to take appropriate action.

      ORS 810.434 requires a biennial report be made to the Oregon Legislature by March 1st of odd-numbered years. The report due in 2017 does not yet appear on the State's site (although the reports for other Oregon municipalities do). So the last report from Albany is the one dated February 2015. It is perhaps informative that this report shows the ODOT ANNUAL data for the Queen/Geary intersection to be: 2003 - 1 2004 - 1 2005 - 3 2006 - 2 2007 - 1 2008 - 2 2009 - 2 2010 - 1 2011 - 1 2012 - 2 2013 - 0 If what the Lt. originally prefaces with "according to our data" there were 11 (in 2015) collisions at the Queen/Geary intersection - then the intersection has become wildly MORE prone to collisions than ever before. Given the Lt.'s explanation that the City's numbers will be LOWER than ODOT because crashes are only required by law to be reported to ODOT. The ODOT figure should be at least 11 and probably more if the Lt.'s testimony is fact-based. Once the Report which was statutorily required to be filed with the Legislature by March 1, 2017 is located, members of the general public such as myself, will be able to compare the published ODOT figures with the Lt. & Mayor's exchange in front of the rest of the City Council on collisions at the Geary/Queen intersection before the vote - of which some had said their decision was based on safety data.

      Unable to explain why the Lt. mentions (about 9 minutes in) anything about using Federal Safety Funds in connection with this since according to the Federal Highway Administration - Section 402: State Highway Safety Programs are explicitly barred from spending any of those funds on automate traffic enforcement systems.

    The house next to my business is actually condemned and is zoned Light Industrial just as we are. When the building comes down, it will no longer be considered residential.

    Trying to redefine "Abstain" and then talking about the corruption of the democratic process and Council operations with choosing to abstain in a vote. Opting to change how voting in the Council works because of a Councilor choosing to utilize the tools at his disposal because some of the Council and the Mayor want to force their own agenda. How is that any different really? Problem solving: Put it on the public ballot then instead of having Councilors vote (though it shouldn't even be necessary as the 2014 election already showed us that 2 of 3 Wards are in favor). The fact that the City Council is ignoring the majority position of Albany (Ward I & II voted in FAVOR) and pushing their own individual agendas against that is abhorrent and THAT is a corruption of the intent of the democratic process. You are elected as representatives and you must represent your constituents if it is not unconstitutional, which in this case, it is not. The Council and the Mayor are not representing the majority of the city as they should be.
