What is Supported Decision Making?
Supported decision-making (SDM) is a process in which people with intellectual and developmental disabilities build their own decision-making skills and develop a structure of support of trusted persons in their lives while retaining all their legal and civil rights. It is increasingly becoming recognized as a preferable and less-restrictive alternative to guardianship here in NYS, nationally, and even internationally.
Why is it important?
In the summer of 2022, Governor Kathy Hochul signed New York’s Supported Decision-Making Agreement Act, built upon Principles developed by SDMNY. This civil rights legislation recognizes SDM as an alternative to guardianship and prohibits discrimination against decisions made by people with Intellectual and developmental disabilities with an agreement developed through SDMNY’s facilitation process. New York Courts are increasingly deciding that as a less-restrictive alternative, SDM can be used to avoid the necessity for guardianship in the first place, or as a means to restore the rights to persons already under guardianship.
This session will provide an overview of the initiative here in NYS, including how to sign up!

I got a call today saying my 5 year old son was approved for disability for language disability…. But we make about $90,000 total… however by tax purposes, I would only be considered. I have a live in boyfriend but he is not the adoptive parent of my child, and my sons father has no contact with my son. Why would they tell me he was approved if we are technically over income? Are they not counting my boyfriends income? They shouldn’t because he is not his dad or his adopted dad…

The schools are chosen depending on availability so you aren’t really picking them. And if you miss Open House many schools act funny about you touring schools. Not like the old days where parents can just visit.

Can you do a video on how to even get that far?? I'm beyond livid how much of a struggle SSI makes it to reach them over the phone. Not to mention how they don't help you in the slightest. You call to apply, to get help. All they do is make you wait anywhere up to over an hour to answer your call JUST TO SAY THEY WILL MAKE YOU AN APPOINTMENT for them to call you on the phone!!!!!!!! As if that isn't RIDICULOUS ENOUGH. I've had them NEVER CALL ME TWICE IN A ROW!!!!!!! Honestly, parents should get money for putting up with this BS treatment!!

Why do they expect families to live on such a small amount of money, even though disability needs and medical needs can be very costly. The income limitations are very unfair, they expect people to survive under extreme duress and financial hardship.

I have a 4 year old with the same condition, and I was denied disability for him because we supposedly make too much monthly. You need to make less than $1,350 a month, which equates to about $325 per check, or $650 for couples at $15,600 annually. If your income before taxes is more than that you will be denied. If you have no income you're in a good position to qualify. Your dad's SSDI would qualify you if it were your income, but you having no income should definitely qualify you.
