      Do you live in the UK? If possible, try talking to your neighbour about your concern and resolving it that way amicably. If that's not successful, seek advice from a solicitor - a Citizens Advice Bureau usually offer a free 30 minute interview with a solicitor or just ask a local law firm themselves. It may be that via a conditional fee agreement, you could take legal action and not risk paying if you lose the case. Most cases are resolved before they go to court via mediation anyway but I would say taking legal action is always a last resort. If your home is a council house, you could also try contacting your local authority about it. I'm not a solicitor and you should always take legal advice, however from what you describe it sounds like you may have grounds for a case there. Good luck.

  • @AccessRealityTruth
    @AccessRealityTruth Před 2 lety

    Very interesting. I've been having some problems with my neighbour since I moved to my current location. The neighbours built a large illegal structure without planning permission in front of my window, but it doesn't block the light though. I asked the neighbour to remove it but instead they rose the height of the fence by 1 extra meter (total 3m), the legal limit is 2m without requiring planning permission. Anyway, I reported the building to the council, and when they found out they installed a very high washing line and they are constantly putting old, large sheets there just to deliberately block my view, they also put 3 signs over 3 meters high, facing directly at my property ('keep out', 'smile you are on camera'). They are constantly removing my items from under the fence and throwing them back over the fence into my garden. He also called me several rude names from over the fence and recorded me with a mobile phone, which I reported to the police, then he got a charged with disturbance of peace for this. Just last week he removed several items from my garden, putting his hands under the fence and pulling them out and throwing them back over the fence into my garden. I have most of these recorded on camera. This has been going on for over 2 years, with the most recent incident happening just last week, which I reported to the police. I was thinking about contacting a solicitor about taking this to court, as this has been affecting my family's health (My wife is having to take tablets for stress), however I was wondering if you had any advice as I'm not sure whether I have a case or not. Thanks

    • @DuncanBunce
      @DuncanBunce Před 2 lety

      I am very sorry to hear this and how it has affected you and your wife. You are clearly doing the right thing by gathering evidence and videos. There appears to be criminal behaviour here, which the police rightly need to investigate. On top of which, seeking an injunction against your neighbour for private nuisance. My advice to anyone in such a situation, is to seek the advice of a solicitor. You can contact your local Citizens Advice Bureau for advice or a telephone consultation. They also often work with local solicitors and can offer a free interview for you to gain legal advice. I wish you all the best and a speedy resolution.
