Madam, मेरे ongoing consumer case में opp party अपने evidence 06 months से नहीं ला रहा है . Opp party को evidence लाने कि last opportunity मिली तो Opp party सिर्फ Affidavit (साक्ष शपथपत्र) ले कर आयी और evidence next date(20 Aug 2024) को जमा करने कि बात कही. Next date (20 Aug) को opp party absent थी, तब मैंने objection किया तो Consumer forum ने मुझे Written Argument जमा करने कि date 07 Sep 2024 order sheet में लिख तो दिया है, लेकिन order sheet में जी भी लिखा है अगर opp party चाहे तो आगे कि proceedings में अपने evidence ला सकती है. अगर मै 07 Sep 2024 को अपना written argument जमा कर देता हूँ और मेरे written argument जमा करने के बाद opp party अपने evidence लाती है तब तो मेरा written argument ख़राब हो जायेगा. ... Plz advice मुझे क्या करना चाहिए..🙏

One of the question regarding issue Some facts that respondent sale the flat to complainant and make an agreement to sale. also possession handover and electricity connection of complainant upon that flat from Jan 2017 later respondents sent a legal notice for make an balance payment and executed ragister sale deed in their favour but respondent not any reply to that notice and filing complaint into consumer forum and demanded amount which paid by him. Respondent not appear into forum and forum passes exparte order against respondents after that complainant file execution but respondents file the appeal before the state commission with delay application this was pending it also deposited half amount so in execution can respindent can claim through file application regarding rent from year Jan 2017 to handover possession with intrest and mental harrasment.
