I have a Marketing Agency under the name EnvyInk. I've owned the domain since 2008, and it has been incorporated for 3 years and 4 months. I was approached by a company called Right Trademark, they said, someone else wanted to trademark my name. They kept hounding me and said if I did nothing, I would forfeit the name to use, even with it having an EIN number and filing status with the IRS. Since I had rights to it first, they offered me services. The company is fraudulent "opinion" as they returned and demanded more money than what was paid. Would I still be able to operate with the name without a trademark for only the name?

You should also talk about the thousands, probably millions, of erroneous takedown notices by rich bullies who leverage their legal remedies way beyond the law. The DMCA makes it easy to eliminate competition, even if that competition is unique and original. Is a creator going to fight for their design on a tee shirt that they have made a profit of $5 so far and go up against a multi-millionaire goliath? Your 60% is probably more like 90%, even for people who have not violated any rights.

I'm starting orphanages. What I've learned up to this point is: If you want the 501(C3) off your back, get an agent/attorney/CPA organization whose business is to do these things. Then accept donations, and they will remind you to update them every month with all of the new activity. My guess is they will make good money on due to their automation and having employees whose sole responsibility to that type of work, who can do in minutes what would take you several hours or require you to hire another person and distract from what you do. If you take the cost and divide it across the money you saved by not paying them, you might find your hourly wage would have 3rd-world factory workers laughing at you.
