If the defendant is not having money then he should collect proof and tell the plaintiff. The lawsuit is not about whether the defendant can pay the money or not it's about whether the defendant owes the specific debt amount to the plaintiff or not. Even if the defendant has no money the court can decide whether the plaintiff has won the lawsuit or you still owe that sum of money to the plaintiff. They can make an agreement when the defendant is not having money the plaintiff and the judge will ask the defendant, again and again, to pay the debt to make a repayment agreement with the plaintiff that is called an agreement for judgement and if the defendant fails to comply with the agreement then it will be a violation of the court order.

If Judge has decided that you owe the money to the plaintiff and the judge had passed for the execution of such decree then it means that now plaintiff has the legal right to take the property of the defendant, The constable will bring a copy of execution and take your car and put a lien on the defendant house, however, the defendant can go for an appeal in the appellate court against such decree

Sir if matter is in City civil court ....can he appeal there or highcourt. ....my amount is 15 lakhs. ....Do..than Judgement takes years....and i won't get my money pls help

@@swaticonsultant2681 If the person is filing a suit in the small causes court then he has to file an appeal in city civil court and if the appeal is filed in city civil court then he has to file an appeal in the High Court, So in your case, you have to file an appeal in the High Court only, for your claimed amount.

Sir but in appeal he has to 1st deposit money than only he can appeal or he can appeal without depositing money in summary suit
