Duane did cop the melody for the "Layla" lick from how Albert sings "There is nothing I can do," but that he turned it into a guitar lick is genius...
Nobody really cops anything. It's language. It's like saying "you're using the same words from the Bible". It's nuances in the delivery and intervals. Duane Allman would say he took it, as an opportunity to pay homage and respect to someone he admired. It's being humble and gracious.
