    What if a change order potentially induces bigger losses and damages? Since there usually isn't a separate contract for a change order, should the main contract state that any change order shall have a limited liability of 100% of the change order itself instead of the full contract?

    What happens if the Head Contractor is also affected by a delay from the client project manager and client? Subcontractors are affected by this delay as well. If there is an instance where the subcontractors procurement delay led to Liquidated Damages? But their still insisting to be paid the full amount of their subcontract. How do we navigate this?

      Hi Helen! Delays caused by the client - there should be a flow down of delay costs and time. The head contractor will need to claim for costs and extension of time under the head contract from the client. The subcontractor should be able to claim for costs and extension of time under the subcontract to the extent that the delay affected them.

      Liquidated damages need to be negotiated upfront with the subcontractor with this in mind to ensure equitable distribution of risk.

    Great info. I work in sales in the construction market (as a sub-contractor with different types of materials or solutions), but I do not have education in construction. So, it is always a pain in the ass to negotiate the contract. If you need to advise someone on where to start educating to becouma a master negotiator as a KENTZ. What would you suggest?

    Funny thing, my job is to prevent exactly what you’re promoting in this video. It’s true that delays and extra (unforeseen) things can come up, which of course should be reimbursed to the contractor, but I’m pretty sure that’s not what you’re talking about!😂Nonetheless, interesting to see how you go about it, would love to have a chat on it

    One thing I can add as a way to instantly improve differentiation: how the customer-facing team members interact with customers. If the business owner can wake up one day and say "I don't have visibility as to how our customers perceive our business because I do not interact with them - the 10 members of our front office staff interact with customers, and I don't monitor the interactions closely (or at all), I leave it up to the employee's own interpersonal skill." So for all the owner knows, customers might want to 'jump ship' to a different business. Or customers might be happy with the 10 employees who deal with customers. Point is, the owner just does not know. Two recent examples: 1) I was at a bank. There were 10 to 15 staff members inside their office or cubicle. There was only one teller interacting with the customers wanting to deposit, withdraw, etc. There were 5 people in line. The one teller was slow. People in line were giving up and walking out. It was 12pm noon. "Time is the most valuable asset." The bank customers are on lunch break. They notice the 14 other 'not my job!' employees at the bank not wanting to help with customers. I finished my deposit and went across the street and opened a new account at a competitor bank. OPPORTUNITY: business owner can make 100% effort to know how his business is being perceived by customers. 2) Long time swimming pool servicing vendor we used for our rental properties. Their customer-facing employees kept making mistakes. We asked for correction. No change. We replaced the vendor. A construction company owner who says "will put major effort into designing how customer-facing staff interact with customers, and will closely monitor them. Will hire those staff on 'people skills' could be a differentiator. I've been hiring contractors in the building trades for a couple decades. It's all over the map, how their customer-facing staff perform. It's a real opportunity to differentiate. Our roofing vendor and our HVAC vendor's customer-facing staff are courteous, punctual, conscientious and when an issue came up with one of the HVAC staff, they apologized and corrected. They've been our sole roofing and sole HVAC vendors for years. Just deciding to become aware of how well your customer-facing staff are performing with your customers is a massive opportunity, because too many vendors just leave it up to the untrained-in-customer-service employees. If the business owner can produce a polished customer-facing staff with incredibly good interpersonal skills with customers, it's a huge advantage, because most small businesses put too much faith in the untrained employee's ability to work well with customers. .

      The technical side of things I cant really help with as I'm not an engineer - however at the end of the day its all about people, how you interact with others, influence others, problem solving, leading people etc. These are the things that are the highest value. Some books. The motive by partick lencioni, The Goal (the theory of constraints) and Influence and Pre-susaion by Robert Cialdini

      Absolutely, landing a high-paying first job sets a good tone for the rest of your career. In my opinion, startups often offer rapid learning curves and responsibilities early on, which is invaluable. However, MNCs are all about a structured learning environment. Roles that require a mix of technical and business often pay better. Both design and execution roles are important, but roles around product strategy and interaction with business stakeholders often edge out purely execution-based jobs in terms of pay - something to think about.
