2024 Mock Trial Finals
Carmel High School takes on Stevenson School for the Mock Trial Finals at the Monterey County Courthouse.
The Mock Trial Program is an exciting law-related educational program that introduces high school students (grades 9-12) to the American legal system. Mock trials are structured like "real" court trials and follow the same rules. The program pairs students with mentors from the legal community. Through one-on-one interactions with attorney coaches, a student's understanding of the law is greatly enhanced.Through role-playing, students gain an understanding of our judicial system--what roles judges, lawyers, juries and witnesses play in the system. Additionally, students develop critical thinking and public speaking skills and a working knowledge of our legal practices and procedures.

    It is reassuring that they are not least looking for ways to reuse and repurposing land and resources of a very historic base. I hope that the promises are met. I hope they find a path to honor and tell the story of the thousands of soldiers that are a part of Fort Ord’s history.🇺🇸

    Can someone correct me if I’m wrong.? Was the defendants first argument to have the evidence removed that the actor understood her rights but misled to believe she had no choice but to relinquish them. Would a better argument have been she actually didn’t know her right. Could it not be argued that had she had actually understood her rights and what the cop had said it would’ve been in her best interest to maintain her position and stop the search until the warrant was present? Like she’s an actress. The law is debated amongst professionals everyday. I mean how many people call freedom of speech but don’t really know how to apply it. Saying “I know my rights” dramatically as an actor would is not an accurate declaration if she doesn’t actually know her rights. If she was not explained her rights and asked if she understood, there is no real way of determining. She could be explained the situation and said “oh, I didn’t know that, she didn’t tell me that. If I had know that I wouldn’t have don’t it” and that would disprove there argument against right saying that she declared “I know my rights” out of ignorance and not because she actually understood them or lied. The responsibility should fall more on the officer (knowing the law) to make sure and understand that an Oman that was not in distress understood her rights. The cop could’ve given her space and then came back in and fully explained her rights. The cop was at fault. She had the responsibility to inform, she force the scene to be seen as a threat by blocking the door and she did not submit the forms. If the forms weren’t even getting approved. Fill g out the paperwork without submitting it means nothing to a court. If it stayed in that state she could not accurately claim she would get in them if they liked it or not. Nah wild call throw it out

    This was a really good mock trial. I think the prosecution would lose on the appellate level for this case. I know this was a mock trial but LOL when I first watched this I was really upset at the judge on her ruling. To be honest this would for sure have a jury panel. The deliberation would take more than just a few seconds that the judge took in her procedure to decide on this ruling. I will give it this based on the details of this crime the evidence doesn't point to anyone else besides the defendant. Yet I do not believe that means that this is beyond A Reasonable Doubt I don't believe there was enough evidence to convict besides the fingerprints and his phone was nearby the scene. It was clear he had a shoulder injury and making a right-handed slash he would not have been able to hurt the victim the way he did. His fingerprints were on the weapon because he gave it to the person as a gift even the detective investigating the crime agreed with that. In fact as far as I can follow along it seems she actually proposed that in her investigation. The motive was very low. There were other people whose phones were nearby. The geofence was not done with the proper warrant as the defense pointed out. It seems to me the judge based on finding the defendant guilty more so on the evidence is not pointing to anyone else despite the stronger motive of other people and the fact that their phones were also nearby when the murder took place. We must remember in our legal system what beyond a reasonable doubt means. It was never verified the defendant was in the room during The Killing. No other evidence aside from what point did he gave the gift to this person that was a knife that was used to stab the victim pointed to the defendant having actually done the crime. This person did not confess and even the geofence done without the warrant did not show that he was actually in the room with his cell phone based on the geofence Data Tracking his cell phone. I don't have access to Lexis or Westlaw but I feel it would be easy to shepardize a case similar to this in which similar evidence such as fingerprints pointing to the person still led to an acquittal. Well how about OJ Simpson? In which much more evidence was pointing to his killing of Nicole Brown Simpson. Yet he was acquitted because it was not Beyond a reasonable doubt that he had done it. Not a very good sighting though is the facts and the details of the OJ Simpson case I believe are very different to this case. But I feel further shepherding would results in sightings in pretty good cases to compare that would acquit this person. A reasonable doubt means, well it means beyond a reasonable doubt. We must remember to keep fairness in the judicial system and to be aware of inconsistencies and errors in the legal system. In real life by imagine this being appealed. In real life I imagine the bar association doing an investigation on this judge and looking for previous inconsistencies in errors and bad rulings and possible mistrials that this judge would have a history of ruling over. Possibly she could be disbarred. You cannot retry a case based on Double Jeopardy but appealing because of a legal error means the trial was in error and the person can definitely have another trial. 😂 I will say this was a mock trial. Definitely this is the realism of this mock trial it looks and sounds so much exactly the way the two opposing counsels would argue their case and do lead examination and cross examination of the defendant and the witnesses that were subpoenaed and make their initial and closing arguments and go back and forth with the judge. I actually have an emotional reaction from watching this. Lol pretty realistic. Some high schools barely have extracurricular activities beyond music lessons. You can learn an instrument really well. And if you become famous enough you'll be a rockstar or something. But a high school with a legal program that teaches students legal procedure? Does it have engineering or architectural classes as well or biology or medicine classes? LOL people need to really consider taking their kid out of whatever high school they're in and putting them in this High School. Very realistic mock trial.

      Some schools do have really good classes and extracurriculars, my high school also has mock trial, engineering, medical programs, and even an automotive class.

      @@thegrimmkitty9786 wow. LOL when I was in high school they had none of that. Even private schools didn't. Things have come a long ways. Depending which school you go to of course. Make the best of it for sure. Once you are out of school it's obviously all up to you.

    These kids did so great! I am in 8th grade and I have a Mock trial today. I am a prosecution attorney doing a cross exam and closing argument. I am hoping to do as good as these guys did! update: it's a few weeks after the debate...my team VERY unfairly lost. everyone agrees that we should have won, we absolutely crushed it!

      @@tailsfan11westandwithukraine Yes I definitely think I did good on my part, especially with my closing argument. Basically my prosecuting team against the other teams defense lost but then in the second round my class’s defense beat the other teams prosecuting team. So we lost the first round (that I was in) and we won the second round (that I wasn’t in). My class also lost on our presentation skills, which we also think was unfair and we actually spoke out about this but they said that the main reason we lost that was because my class was very up down, like there were kids on my class that did very well but there were also kids that did very poorly and we weren’t consistent. I think that is really unfair though because what about the kids like me and my best friend that did really well? We get a loss too just because some other kids in my class didn’t put as much effort in? Sure the other team was consistent but they didn’t do as good as us. Besides that though I think me and my best friend did the best out of every one, presentation wise and with our prosecuting.

      @@areidemío It really depends, the case I did wasn't too hard but there were times where it was a little complicated. You will probably get some cases where it will be really easy but you might also get some cases that could be rather complicated. One thing I did was really pay attention to the details (dates, times, etc.) in witness statements and evidence and I looked for things that maybe didn't line up or things that contradicted each other in witness statements and basically used those to say like we can't trust this person because they are contradicting evidence or something another witness said that we know is a fact. If you are on the defense in a case and you found something like that it would be really helpful to your case because as the defense your trying to bring up a reasonable doubt right? So if you are ever on defense that might be a good idea. Doing that also helped me understand the case more. Idk if that tip was common sense or not but it wasn't to my class. As for the terms, it didn't take me too long to start understanding them. It's kind of confusing in the beginning but you'll get them, just working on a case really gets you familiar with the terms so I wouldn't worry about not understanding it. I hope this answers your question!

    Thoroughly enjoyed watching the Mock Trial Finals between Carmel High School and Stevenson School! It's evident that the students poured a significant amount of effort into preparing for their roles, showcasing not just their understanding of legal procedures but also their public speaking skills. While the trial had its Hollywood-esque moments and the portrayals may not fully capture the gravitas seen in real courtrooms, the educational value and entertainment provided were unmistakable. Kudos to all the students involved for their dedication and hard work. It’s clear that such experiences are invaluable in understanding the legal system and developing critical thinking. Well done to everyone involved!

    If I am a defense attorney doing a pretrial motion, do I have to quote other cases? Or does arguing my point suffice... I notice here they have alternate examples of similar cases to back up their standing and opinion.

      This Mock Trial competition is held by the Teach Democracy/Constitutional Rights Foundation. They provide a case packet that includes the pretrial arguments both sides should be making, including a set of cases with similar issues for attorneys to reference. You are scored on your use of the cases. Judges will also ask many questions about the cases provided, as the judge does here. So, no, making the argument on its own is not enough. You need to back it up with case law. Not doing so would severely lower your score.

    I'm glad to hear that the old WW2 era barracks are going to be removed. While most of us have fond memories of the entire base, seeing those buildings marked with graffiti and practically falling down on themselves is depressing. I hope that the local areas find a way to marry "Best Use" and "economic development". If i could see one thing implemented in my lifetime, it would be that ONE SINGLE UNIT of the old WW2 era barracks be rehabilitated and preserved as an historical record of what was once there. Truthfully, much of the old Ord lives on now only in memories of we: the aging veterans who were there, and (if we are lucky) some cherished photos. From the age when taking pictures was a drawn out process, involving finishing the roll of film, sending it to be developed, waiting for it to be sent back to the AAFES Post Exchange, and finally opening the envelope to discover what we had captured.😊
