    The timber industry has been fighting the efforts to make marijuana legal because hemp is such a wonderful wood replacement that can be grown extremely easily. With legalization throughout Canada and many states in the US we should be able to stop destroying our forest 4 Lumber needs. The best science tells us that fires burn with greater severity in treated Forest than in protected Forest. Meaning that if you thin a forest it is more likely to burn severely due to the canopy drying out and wind driven fires sweeping through.

    Protected Forest burn with less severity and those that have been treated! Thinning allows wind to dry out the forest floor. All logs should be retained on the property if Forest Health is really the goal. Those logs will hold moisture making the forest more drought-resistant. Woodpeckers rely on bark beetles, goshawks and other Raptors rely on the woodpeckers. Replanted Forest burn with higher severity than naturally regenerative areas.

    I just found some bushes/trees (10'-15' tall) that I think are oaks. On the parcel next to my yard in Vista 92081, southern California just north of San Diego. Just south of the 78 Freeway near Emerald and 78. What caught my eye was that they are in bloom so I took a closer look, and the pollen swirled like crazy when I touched the branch, that is when I noticed the leaves looked like oak leaves. I found two distinct varieties with different leaves and growth habits. Flowers are very similar. Trying to figure out which varieties they are.

    SYNDICATED CONSERVATION EASEMENTS I have and do advise anyone who is considering entering into a syndicated conservation easement transaction today: do not even think about it. The litigation costs - let alone the time and energy - of a battle with the IRS simply cannot be understated. As a tax controversy and tax litigation expert witness who has never lost a case, I represent clients who have involvement with conservation easements. It is because of that representation, however, that no matter how much I think a particular conservation easement case has a very good chance of being decided in favor of the taxpayer, I know that such a victory may be Pyrrhic at best. Anyone considering whether to settle or fight in a conservation easement case should carefully consider the financial and emotional cost of litigation when evaluating a possible settlement.     CONSERVATION EASEMENTS ARE AUDITED Starting in the early 2000’s, developers and tax shelter promoters began exploiting conservation easements to provide huge tax deductions for donations that provided little or no conservation benefit. The problem reached the point that the IRS issued Notice 2017-10 which described certain syndicated conservation easement arrangements and listed them as tax shelter transactions.     The IRS is auditing conservation easements. Some promoters, the IRS notes, have tried to distance their particular scheme from those in the IRS crosshairs, claiming their transactions are “different” and don’t suffer from the same flaws as the stated plans. The agency will soon publish updates to the Conservation Easement Audit Technique Guide that set out new arguments that taxpayers can expect the IRS to make in SCE cases. The newly established Office of Fraud Enforcement and the National Fraud Counsel are teaming up with examining agents and Chief Counsel attorneys to canvas cases for additional fraud considerations, which might include assertion of the 75% civil fraud penalty, or where applicable, referrals to Criminal Investigation. The CC Notice, the IRS reminds, also responds to a frequent question raised by several groups of partners who have approached the IRS Chief Counsel, asking to resolve their cases. The Chief Counsel settlement initiative requires the partnership engaged in the SCE transaction - and all of its partners - to agree to settle on the terms offered by the IRS. The terms include a complete disallowance of the claimed charitable contribution deductions and penalties, although some partners may deduct their cost of investing in the partnership. In rare cases, Chief Counsel has the authority to permit less than all the partners to settle on these terms.     What you've done may work well on flat ground with relatively few trees, but it's important to consider that acres are measured in horizontal "map" distance. Steep slopes will require the radius to be adjusted to account for this, even if the intent is not to have a professional level inventory. I think a reasonable step a landowner could take would be to place 4 pin flags at cardinal directions on the plot, which have been measured to account for changes in slope. Also, consider that on a 1/10 acre plot, every missed or added tree represents 10 trees per acre - this can be a big deal with small diameter trees when there could be many dozen on a plot. I recommend a sub-sample for small diameter trees under 4-6" DBH of 1/100 acre size.

    The Internal Revenue Service has yet again publicly reiterated its commitment to challenge syndicated conservation easement transactions-transactions that it has, in recent years, labeled as “listed” transactions, tax-speak for “buyer beware.” In a recent press release, the IRS warned yet again that it believes that these easement deductions are “abusive transactions” and hinted that taxpayers can expect to face “new arguments” from its arsenal of legal theories. To add insult to injury, the IRS further cautioned that its newly-established “Office of Fraud Enforcement and the National Fraud Counsel are coordinating . . . to canvas cases for additional fraud considerations,” including civil fraud penalties and referrals to criminal investigation. The stakes, in other words, remain high for participants in syndicated conservation easement transactions.     The IRS previously identified certain syndicated conservation easements as “listed transactions” under Notice 2017-10-specifically, transactions for which investors in pass-through entities receive promotional material offering the possibility of a charitable contribution deduction worth at least two and half times their investment. Today’s release indicates that for many of these transactions, the deduction taken is significantly higher than 250% of the investment.
